Records of all drug and alcohol test results and related\n\ninformation maintained by the employer shall be the property of the\n\nemployer and, upon the request of the applicant or employee tested,\n\nshall be made available for inspection and copying to the applicant\n\nor employee. Except as provided in subsection B of this section, an\n\nemployer shall not release such records to any person other than the\n\napplicant, employee or the review officer.\n\nB. Records of all drug and alcohol test results and related\n\ninformation maintained by the employer may be released by the\n\nemployer for any of the following purposes:\n\n1. As admissible evidence by an employer or the individual\n\ntested in a case or proceeding before a court of record or\n\nadministrative agency if either the employer or the individual\n\ntested are named parties in the case or proceeding;\n\n2. In order to comply with a valid judicial or administrative\n\norder; or\n\n3. To an employer's employees, agents and representatives who\n\nneed access to such records in the administration of the Standards\n\nFor Workplace Drug and Alcohol Testing Act.\n\nC. A testing facility, or any agent, representative or designee\n\nof the facility, or any review officer, shall not disclose to any\n\nemployer, based on the analysis of a sample collected from an\n\napplicant or employee for the purpose of testing for the presence of\n\ndrugs or alcohol, any information relating to the general health,\n\npregnancy or other physical or mental condition of the applicant or\n\nemployee.\n\nA testing facility shall release the results of the drug or\n\nalcohol test, and any analysis and information related thereto, to\n\nthe individual tested upon request.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2569e74944ae667ae370371e5f660be17d4c29b4c4fe9b0ac7659a7771ea8204","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-559.1","next":"us-ok/okla.-stat.-tit.-40-40-562"},"notice":"GroundRules: Original legal text.
