An employer's policy shall state the disciplinary actions\n\nthat may be taken upon a refusal to undergo a drug or alcohol test\n\nor for a positive test for the presence of drugs or alcohol.\n\nB. An employer may take disciplinary action, up to and\n\nincluding discharge, against an employee who refuses to undergo drug\n\nor alcohol testing conducted in accordance with the provisions of\n\nSection 551 et seq. of this title or who tests positive for the\n\npresence of drugs or alcohol.\n\nC.
