Stat. tit. 40, § 40-600.2","heading":"Definitions","body":"1. “Client” means any person who enters into a coemployment\n\nrelationship as a coemployer with a professional employer\n\norganization (PEO);\n\n2. “Coemployer” means either a PEO or a client;\n\n3. “Coemployment relationship” means:\n\na. as between coemployers, a relationship whereby the\n\nrights, duties and obligations of an employer which\n\narise out of an employment relationship have been\n\nallocated between coemployers pursuant to a\n\nprofessional employer agreement and the Oklahoma\n\nProfessional Employer Organization Recognition and\n\nRegistration Act, and which is intended to be an\n\nongoing relationship, rather than a temporary or\n\nproject specific relationship, and\n\nb. as between each PEO and a covered employee as to which\n\na professional employer agreement applies, an\n\nemployment relationship whereby:\n\n(1) such PEO is entitled to enforce those rights, and\n\nobligated to perform those duties and\n\nobligations, allocated to such PEO by the\n\nprofessional employer agreement and the Oklahoma\n\nProfessional Employer Organization Recognition\n\nand Registration Act, and\n\n(2) such covered employee is entitled to enforce\n\nagainst such PEO those duties and obligations\n\nallocated to the PEO by the professional employer\n\nagreement and the Oklahoma Professional Employer\n\nOrganization Recognition and Registration Act;\n\nc. as between each client and a covered employee to which\n\na professional employer agreement applies and\n\nemployment relationship whereby:\n\n(1) such client is entitled to enforce those rights,\n\nand obligated to provide and perform those\n\nemployer obligations allocated to such client by\n\nthe professional employer agreement and the\n\nOklahoma Professional Employer Organization\n\nRecognition and Registration Act and whereby such\n\nclient is responsible for any employer right or\n\nobligation not otherwise allocated by the\n\nprofessional employer agreement of the Oklahoma\n\nProfessional Employer Organization Recognition\n\nand Registration Act, and\n\n(2) such covered employee is entitled to enforce\n\nagainst such client those duties and obligations\n\nallocated to the client by the professional\n\nemployer agreement and the Oklahoma Professional\n\nEmployer Organization Recognition and\n\nRegistration Act and any other duties and\n\nobligations of an employer not otherwise\n\nallocated by the professional employer agreement\n\nor the Oklahoma Professional Employer\n\nOrganization Recognition and Registration Act;\n\n4. “Commissioner” means the Insurance Commissioner of the State\n\nof Oklahoma;\n\n5. “Covered Employee” means an individual having a coemployment\n\nrelationship with a PEO and a client who have entered into a\n\nprofessional employer agreement with respect to such person, and\n\nshall include the client’s officers, directors, shareholders,\n\npartners and managers to the extent such persons act as operational\n\nmanagers or perform services for the client;\n\n6. “Department” means the Department of Insurance of the State\n\nof Oklahoma;\n\n7. “Person” means any individual, partnership, corporation,\n\nlimited liability company, association, or any other form of legally\n\nrecognized entity;\n\n8. “Professional employer agreement” means a written contract\n\nby and between a client and a PEO under which the PEO and the client\n\nagree to establish a coemployment relationship and which satisfies\n\nthe requirements of subsection C of Section 7 of this act;\n\n9. “Professional Employer Organization” or PEO means any person\n\nengaged in the business of providing professional employer services.\n\nA person engaged in the business of providing professional employer\n\nservices shall be subject to registration under the Oklahoma\n\nProfessional Employer Organization Recognition and Registration Act\n\nregardless of its use of the term “professional employer\n\norganization”, “PEO”, “staff leasing company”, “registered staff\n\nleasing company”, “employee leasing company”, or any other name;\nf providing professional employer\n\nservices shall be subject to registration under the Oklahoma\n\nProfessional Employer Organization Recognition and Registration Act\n\nregardless of its use of the term “professional employer\n\norganization”, “PEO”, “staff leasing company”, “registered staff\n\nleasing company”, “employee leasing company”, or any other name;\n\n10. “Professional employer services” means the service of\n\nentering into coemployment relationships under the Oklahoma\n\nProfessional Employer Organization Recognition and Registration Act,\n\nin which, except in isolated instances, all or a majority of the\n\nemployees providing services to a client or to a division or work\n\nunit of client are covered employees;\n\n11. “Registrant” means a PEO registered under the Oklahoma\n\nProfessional Employer Organization Recognition and Registration Act;\n\nand\n\n12. “Temporary help services” means a service whereby a person\n\nhires workers and assigns them to a person for a temporary time\n\nperiod or nonpermanent basis to support or supplement the other\n\nperson’s workforce in special work situations such as, but not\n\nlimited to, employee absences, temporary skill shortages, seasonal\n\nworkloads, and special assignments and projects.
