Nothing contained in the\n\nOklahoma Professional Employer Organization Recognition and\n\nRegistration Act or in any professional employer agreement shall\n\naffect, modify or amend any collective bargaining agreement, or the\n\nrights or obligations of any client, PEO, or covered employee under\n\nthe National Labor Relations Act.\n\nB. Licensing. Nothing contained in the Oklahoma Professional\n\nEmployer Organization Recognition and Registration Act or any\n\nprofessional employer agreement shall affect, modify or amend any\n\nstate, local, or federal licensing, registration, or certification\n\nrequirement applicable to any client or covered employee.\n\nC. Licensed employees. A covered employee who must be\n\nlicensed, registered, or certified according to law or regulation is\n\ndeemed solely an employee of the client for purposes of any such\n\nlicense, registration, or certification requirement.\n\nD. Licensed activities. A PEO shall not be deemed to engage in\n\nany occupation, trade, profession, or other activity that is subject\n\nto licensing, registration, or certification requirements, or is\n\notherwise regulated by a governmental entity solely by entering into\n\nand maintaining a coemployment relationship with a covered employee\n\nwho is subject to such requirements or regulation.\n\nE. Tax credits and other incentives. For purposes of\n\ndetermination of tax credits and other economic incentives provided\n\nby this state and based on employment, covered employees shall be\n\ndeemed employees solely of the client. A client shall be entitled\n\nto the benefit of any tax credit, economic incentive, or other\n\nbenefit arising as the result of the employment of covered employees\n\nof such client.
