Net worth and bonding. Each PEO shall maintain either:\n\n1. A minimum net worth of Fifty Thousand Dollars ($50,000.00),\n\nas reflected in the financial statements submitted to the\n\nCommissioner with the initial registration and each annual renewal;\n\nor\n\n2. A bond or securities with a minimum market value of Fifty\n\nThousand Dollars ($50,000.00), held by a depository designated by\n\nthe Commissioner, securing payment by the PEO of all taxes, wages,\n\nbenefits or other entitlement due to or with respect to a covered\n\nemployee, if the PEO does not make such payments when due. Any bond\n\nor securities deposited under this subsection shall not be included\n\nfor the purpose of calculation of the minimum net worth required by\n\nthis subsection.\n\nB. Payroll tax payments. A PEO shall submit to the\n\nCommissioner, within ninety (90) days after the end of each calendar\n\nquarter, a statement by an independent certified public accountant\n\nthat all applicable state payroll taxes for covered employees\n\nlocated in this state have been paid on a timely basis for that\n\nquarter.\n\nC. Record confidentiality. All records, reports and other\n\ninformation obtained from a PEO under the Oklahoma Professional\n\nEmployer Organization Recognition and Registration Act, except to\n\nthe extent necessary for the proper administration of the Oklahoma\n\nProfessional Employer Organization Recognition and Registration Act\n\nby the Department, shall be confidential and shall not be published\n\nor open to public inspection other than to public employees in the\n\nperformance of their public duties.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3bb08179c15d48fc08101bb6d35e7fb336343ce90239fbc5d929c2d5e0ea0b36","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-600.5","next":"us-ok/okla.-stat.-tit.-40-40-600.7"},"notice":"GroundRules: Original legal text.
