Stat. tit. 40, § 40-78","heading":"Evidence of age of child - Certificate of physical fitness","body":"The Commissioner or his designee, truant officer, or other\n\nperson charged with the administration of this article, may make\n\ndemand on an employer in whose factory or establishment a child\n\napparently under the age of sixteen (16) years is employed or\n\npermitted or suffered to work, and whose employment certificate is\n\nnot then filed as required by this section, that such employer shall\n\neither furnish him, within ten (10) days, evidence satisfactory to\n\nhim that such child is in fact over sixteen (16) years of age, or\n\nshall cease to employ or permit or suffer such child to work in such\n\nfactory or establishment. Such officer may require from such\n\nemployer the same evidence of age of such child as is required on\n\nthe issuance of an employment certificate; and the employer\n\nfurnishing such evidence shall not be required to furnish any\n\nfurther evidence of the age of the child. In case such employer\n\nshall fail to produce and deliver to such officer, within ten (10)\n\ndays after such demand, such evidence of age herein required by him,\n\nand shall thereafter continue to employ such child to work in such\n\nfactory or establishment, proof of the giving of such notice and of\n\nsuch failure to produce and file such evidence shall be prima facie\n\nevidence in any prosecution brought for violation of this provision\n\nof this article that such child is under sixteen (16) years of age\n\nand is unlawfully employed: Provided, that the Commissioner or his\n\ndesignee shall have the power to demand a certificate of physical\n\nfitness from some licensed physician in good standing in this state\n\nin case of children who may appear to him physically unable to\n\nperform the labor at which they may be engaged, and shall have power\n\nto prohibit the employment of any minor that cannot obtain such a\n\ncertificate.","path":["OK Code","Title 40"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os40.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6be466fe9cacd614e8939a51dcc74e7ab1dd027334516fc836fae44c59b2ee07","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-40-40-77","next":"us-ok/okla.-stat.-tit.-40-40-79"},"notice":"GroundRules: Original legal text.
