Stat. tit. 41, § 41-121","heading":"Landlord's breach of rental agreement - Deductions from","body":"rent for repairs - Failure to supply heat, water or other essential\n\nservices - Habitability of dwelling unit.\n\nA. Except as otherwise provided in this act, if there is a\n\nmaterial noncompliance by the landlord with the terms of the rental\n\nagreement or a noncompliance with any of the provisions of Section\n\n118 of this title which noncompliance materially affects health or\n\nsafety, the tenant may deliver to the landlord a written notice\n\nspecifying the acts and omissions constituting the breach and that\n\nthe rental agreement will terminate upon a date not less than thirty\n\n(30) days after receipt of the notice if the breach is not remedied\n\nwithin fourteen (14) days, and thereafter the rental agreement shall\n\nso terminate as provided in the notice unless the landlord\n\nadequately remedies the breach within the time specified.\n\nB. Except as otherwise provided in this act, if there is a\n\nmaterial noncompliance by the landlord with any of the terms of the\n\nrental agreement or any of the provisions of Section 118 of this\n\ntitle which noncompliance materially affects health and the breach\n\nis remediable by repairs, the reasonable cost of which is equal to\n\nor less than one month's rent, the tenant may notify the landlord in\n\nwriting of his or her intention to correct the condition at the\n\nlandlord's expense after the expiration of fourteen (14) days. If\n\nthe landlord fails to comply within said fourteen (14) days, or as\n\npromptly as conditions require in the case of an emergency, the\n\ntenant may thereafter cause the work to be done in a workmanlike\n\nmanner and, after submitting to the landlord an itemized statement,\n\ndeduct from his or her rent the actual and reasonable cost or the\n\nfair and reasonable value of the work, not exceeding the amount\n\nspecified in this subsection, in which event the rental agreement\n\nshall not terminate by reason of that breach.\n\nC. Except as otherwise provided in this act, if, contrary to\n\nthe rental agreement or Section 118 of this title, the landlord\n\nwillfully or negligently fails to supply heat, running water, hot\n\nwater, electric, gas or other essential service, the tenant may give\n\nwritten notice to the landlord specifying the breach and thereafter\n\nmay:\n\n1. Upon written notice, immediately terminate the rental\n\nagreement; or\n\n2. Procure reasonable amounts of heat, hot water, running\n\nwater, electric, gas or other essential service during the period of\n\nthe landlord's noncompliance and deduct their actual and reasonable\n\ncost from the rent; or\n\n3. Recover damages based upon the diminution of the fair rental\n\nvalue of the dwelling unit; or\n\n4. Upon written notice, procure reasonable substitute housing\n\nduring the period of the landlord's noncompliance, in which case the\n\ntenant is excused from paying rent for the period of the landlord's\n\nnoncompliance.\n\nD. Except as otherwise provided in this act, if there is a\n\nnoncompliance by the landlord with the terms of the rental agreement\n\nor Section 118 of this title, which noncompliance renders the\n\ndwelling unit uninhabitable or poses an imminent threat to the\n\nhealth and safety of any occupant of the dwelling unit and which\n\nnoncompliance is not remedied as promptly as conditions require, the\n\ntenant may immediately terminate the rental agreement upon written\n\nnotice to the landlord which notice specifies the noncompliance.\n\nE.
