Stat. tit. 42, § 42-173","heading":"Parties","body":"In such actions all persons whose liens are filed as herein\n\nprovided shall be made parties, and issues shall be made and trials\n\nhad as in other cases. Where such action is brought by a\n\nsubcontractor, or other person not the original contractor, such\n\noriginal contractor shall be made a party defendant, and shall at\n\nhis own expense defend against the claim of every subcontractor, or\n\nother person claiming a lien under this chapter, and if he fails to\n\nmake such defense the owner may make the same at the expense of such\n\ncontractor; and until all such claims, costs and expenses are\n\nfinally adjudicated, and defeated or satisfied, the owner shall be\n\nentitled to retain from the contractor the amount thereof, and such\n\ncosts and expenses as he may be required to pay: Provided, that if\n\nthe sheriff of the county in which such action is pending shall make\n\nreturn that he is unable to find such original contractor, the court\n\nmay proceed to adjudicate the liens upon the land and render\n\njudgment to enforce the same with costs.","path":["OK Code","Title 42"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os42.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"eab537546bb61c9f9822b24e6a0d846d1f6d9e29587c9e5b275cfe285be20553","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-42-42-172","next":"us-ok/okla.-stat.-tit.-42-42-174"},"notice":"GroundRules: Original legal text.
