Every hospital in this state, which shall furnish emergency\n\nmedical or other service to any patient injured by reason of an\n\naccident not covered by the Workers' Compensation Code, shall, if\n\nsuch injured party shall assert or maintain a claim against another\n\nfor damages on account of such injuries, have a lien upon any\n\nrecovery or sum had or collected or to be collected by such patient,\n\nor by his or her heirs, personal representatives or next of kin in\n\nthe case of his or her death, whether by judgment or by settlement\n\nor compromise to the amount of the reasonable and necessary charges\n\nof such hospital for the treatment, care and maintenance of such\n\npatient in such hospital up to the date of payment of such damages.\n\nProvided, however, the lien shall be inferior to any lien or claim\n\nof any attorney or attorneys for handling the claim on behalf of\n\nsuch patient, his or her heirs or personal representatives;\n\nprovided, further, that the lien herein set forth shall not be\n\napplied or considered valid against any claim for amounts due under\n\nthe Workers' Compensation Code in this state.\n\nB. In addition to the lien provided for in subsection A of this\n\nsection, every hospital in this state, which shall furnish emergency\n\nmedical or other service to any patient injured by reason of an\n\naccident not covered by the Workers' Compensation Code, shall have,\n\nif the injured person asserts or maintains a claim against an\n\ninsurer, a lien for the amount due for the emergency medical or\n\nother service upon any monies payable by the insurer to the injured\n\nperson. Provided, however, the lien shall be inferior to any lien\n\nor claim of any attorney or attorneys for handling the claim on\n\nbehalf of such patient, his or her heirs or personal\n\nrepresentatives; provided, further, that the lien herein set forth\n\nshall not be applied or considered valid against any claim for\n\namounts due under the Workers' Compensation Code in this state.\n\nC. This section shall apply, in medically referred cases, to a\n\nmedical diagnostic imaging facility not affiliated with a hospital\n\nthat provides diagnostic imaging that includes, but is not limited\n\nto, modalities such as Magnetic Resonance Imaging (MRI), Computed\n\nTomography (CT) and Positron Emission Tomography (PET).","path":["OK Code","Title 42"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os42.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"13d6cf4d2199a24f147af287597b550a9a92f129d2654f2f4993bf9b86ebfe02","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-42-42-4","next":"us-ok/okla.-stat.-tit.-42-42-44"},"notice":"GroundRules: Original legal text.
