Stat. tit. 43, § 43-103","heading":"Venue for any action for divorce, annulment of a marriage","body":"or legal separation.\n\nA. The venue of any action for divorce, annulment of a marriage\n\nor legal separation may be in the following counties:\n\n1. An action for divorce or annulment of a marriage may be\n\nfiled in the county in which the petitioner has been a resident for\n\nthe thirty (30) days immediately preceding the filing of the\n\npetition or in the county in which the respondent is a resident;\n\nprovided, the action may be assigned for trial in any county within\n\nthe judicial district by the chief judge of the district; and\n\n2. An action for legal separation may be brought in the county\n\nin which either party is a resident at the time of the filing of the\n\npetition.\n\nB. The court may, upon application of a party, transfer an\n\naction for divorce, annulment of marriage or legal separation at any\n\ntime after filing of the petition to any county where venue would be\n\nproper under subsection A of this section if the requirements of\n\nsubsection C or D of this section are met.\n\nC. The court shall grant a party’s application for change of\n\nvenue when the other party is not a resident of this state at the\n\ntime the application for change of venue is filed, or the plaintiff\n\nhas departed from this state and has been absent for more than six\n\n(6) months preceding the date the application for change of venue is\n\nfiled, and transfer is requested to the county where the applying\n\nparty resides in this state.\n\nD. The court shall grant a party’s application for change of\n\nvenue when the court determines that it is an inconvenient forum\n\nunder the circumstances and the court in another county is a more\n\nappropriate forum consistent with the factors in subsection B of\n\nSection 551-207 of the Uniform Child Custody Jurisdiction and\n\nEnforcement Act after substitution of the word \"county\" for the word\n\n\"state\" in such section of the act, and transfer is requested to the\n\ncounty where the applying party resides in the state.","path":["OK Code","Title 43"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"236b71571eceeb2353c39ba9500573148b9620bcfe9b4c15c88404cefa959909","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43-43-102","next":"us-ok/okla.-stat.-tit.-43-43-104"},"notice":"GroundRules: Original legal text.
