Stat. tit. 43, § 43-111.3","heading":"Duty to facilitate visitation - Interference with","body":"visitation rights of noncustodial parent - Motion for enforcement.\n\nA. Any order of the court providing for visitation shall\n\ncontain a provision stating that the custodial parent has a duty to\n\nfacilitate visitation of a minor child with the noncustodial parent.\n\nB. When a noncustodial parent has been granted visitation\n\nrights and those rights are denied or otherwise interfered with by\n\nthe custodial parent, in addition to the remedy provided in\n\nsubsection B of Section 111.1 of this title, the noncustodial parent\n\nmay file with the court clerk a motion for enforcement of visitation\n\nrights. The motion shall be filed on a form provided by the court\n\nclerk. Upon filing of the motion, the court shall immediately set a\n\nhearing on the motion, which shall be not more than twenty-one (21)\n\ndays after the filing of the motion.\n\nC. Notice of a hearing pursuant to subsection A of this section\n\nshall be given to all interested parties by certified mail, return\n\nreceipt requested, or as ordered by the court.\n\nD. If the court finds that visitation rights of the\n\nnoncustodial parent have been unreasonably denied or otherwise\n\ninterfered with by the custodial parent, the court shall enter an\n\norder providing for one or more of the following:\n\n1. A specific visitation schedule;\n\n2. Compensating visitation time for the visitation denied or\n\notherwise interfered with, which time shall be of the same type\n\n(e.g. holiday, weekday, weekend, summer) as the visitation denied or\n\notherwise interfered with, and shall be at the convenience of the\n\nnoncustodial parent;\n\n3. Posting of a bond, either cash or with sufficient sureties,\n\nconditioned upon compliance with the order granting visitation\n\nrights;\n\n4. Attendance of one or both parents at counseling or\n\neducational sessions which focus on the impact of visitation\n\ndisputes on children;\n\n5. Supervised visitation; or\n\n6. Any other remedy the court considers appropriate, which may\n\ninclude an order which modifies a prior order granting child\n\ncustody.\n\nE. The prevailing party shall be granted reasonable attorney\n\nfees, mediation costs, and court costs.\n\nF. Final disposition of a motion filed pursuant to this section\n\nshall take place no later than forty-five (45) days after filing of\n\nthe motion.\n\nG.
