In this section:\n\n1. “Adult child” means a child eighteen (18) years of age or\n\nolder.\n\n2. “Child” means a son or daughter of any age.\n\nB. 1. The court may order either or both parents to provide\n\nfor the support of a child for an indefinite period and may\n\ndetermine the rights and duties of the parents if the court finds\n\nthat:\n\na. the child, whether institutionalized or not, requires\n\nsubstantial care and personal supervision because of a\n\nmental or physical disability and will not be capable\n\nof self-support, and\n\nb. the disability exists, or the cause of the disability\n\nis known to exist, on or before the eighteenth\n\nbirthday of the child.\n\n2. A court that orders support under this section shall\n\ndesignate a parent of the child or another person having physical\n\ncustody or guardianship of the child under a court order to receive\n\nthe support for the child. The court may designate a child who is\n\neighteen (18) years of age or older to receive the support directly.\n\nC. 1. A suit provided by this section may be filed only by:\n\na. a parent of the child or another person having\n\nphysical custody or guardianship of the child under a\n\ncourt order, or\n\nb. the child if the child:\n\n(1) is eighteen (18) years of age or older,\n\n(2) does not have a mental disability, and\n\n(3) is determined by the court to be capable of\n\nmanaging the child’s financial affairs.\n\n2. The parent, the child, if the child is eighteen (18) years\n\nof age or older, or other person may not transfer or assign the\n\ncause of action to any person, including a governmental or private\n\nentity or agency, except for an assignment made to the Title IV-D\n\nagency.\n\nD. 1. A suit under this section may be filed:\n\na. regardless of the age of the child, and\n\nb. as an independent cause of action or joined with any\n\nother claim or remedy provided by this title.\n\n2. If no court has continuing, exclusive jurisdiction of the\n\nchild, an action under this section may be filed as an original\n\nsuit.\n\n3. If there is a court of continuing, exclusive jurisdiction,\n\nan action under this section may be filed as a suit for modification\n\npursuant to Section 115 of this title.\n\nE. In determining the amount of support to be paid after a\n\nchild’s eighteenth birthday, the specific terms and conditions of\n\nthat support, and the rights and duties of both parents with respect\n\nto the support of the child, the court shall determine and give\n\nspecial consideration to:\n\n1. Any existing or future needs of the adult child directly\n\nrelated to the adult child’s mental or physical disability and the\n\nsubstantial care and personal supervision directly required by or\n\nrelated to that disability;\n\n2. Whether the parent pays for or will pay for the care or\n\nsupervision of the adult child or provides or will provide\n\nsubstantial care or personal supervision of the adult child;\n\n3. The financial resources available to both parents for the\n\nsupport, care, and supervision of the adult child; and\n\n4. Any other financial resources or other resources or programs\n\navailable for the support, care, and supervision of the adult child.\n\nF.
