When a parent is required by a court or administrative order\n\nto provide health coverage which is available through an employer\n\ndoing business in this state, the employer is required:\n\n1. To permit the parent to enroll under family coverage any\n\nchild who is otherwise eligible for coverage without regard to any\n\nenrollment season restrictions;\n\n2. To enroll the child under family coverage and to deduct the\n\nemployee’s cost of the coverage from the employee's wages. The\n\nenrollment shall be made upon application to the employer by the\n\nchild's custodial person, by the state agency administering the\n\nMedicaid program or the state agency administering the child support\n\nprogram under Title IV-D of the Social Security Act;\n\n3. Not to disenroll or eliminate coverage of a child unless the\n\nemployer is provided satisfactory written evidence that:\n\na. the court order is no longer in effect,\n\nb. the child is or will be enrolled in comparable\n\ncoverage which will take effect no later than the\n\neffective date of disenrollment, or\n\nc. the employer has eliminated family health coverage for\n\nall of its employees;\n\n4. Upon request, to provide complete information to the\n\ncustodial person, the state agency administering the Medicaid\n\nprogram or the state agency administering the child support program\n\nunder Title IV-D of the Social Security Act regarding any insurance\n\nbenefits to which the child is entitled, and any forms,\n\npublications, or documents necessary to apply for or to utilize the\n\nbenefits;\n\n5. Permit the custodial person, the designated agency\n\nadministering the State Medicaid Program, or the provider with\n\napproval, to submit claims for covered services without the approval\n\nof the noncustodial parent; and\n\n6. Make payments on claims submitted in accordance with\n\nparagraph 5 of this subsection directly to the custodial person, the\n\ndesignated agency administering the State Medicaid Program, or the\n\nprovider.\n\nB. If child support services are being provided under the state\n\nchild support plan as provided under Section 237 of Title 56 of the\n\nOklahoma Statutes, the Child Support Enforcement Division shall\n\nnotify the parent’s employer to enroll the child in health care\n\ncoverage available under the employer’s plan by sending the employer\n\na National Medical Support Notice issued pursuant to Section\n\n466(a)(19) of the Social Security Act, and Section 609(a)(5)(C) of\n\nthe Employee Retirement Income Security Act of 1974. The employer\n\nshall comply with the National Medical Support Notice. The employer\n\nmay be fined up to Two Hundred Dollars ($200.00) per month per child\n\nfor each failure to comply with the requirements of the National\n\nMedical Support Notice. Fines collected shall be remitted to the\n\nChild Support Revenue Enhancement Fund created pursuant to Section\n\n225 of Title 56 of the Oklahoma Statutes.\n\nC. An employer may not be fined under this section where an\n\nemployee fails to contribute his or her portion of a health\n\ninsurance premium.\n\nD.
