Stat. tit. 43, § 43-118A","heading":"Definitions","body":"As used in Section 118 et seq. of this title:\n\n1. \"Adjusted Gross Income\" (AGI) means the net determination of\n\nthe income of a parent, calculated by modifying the gross income of\n\nthe parent as follows:\n\na. adding to the gross income of the parent any Social\n\nSecurity benefit paid to the child on the account of\n\nthe parent,\n\nb. deducting from gross income the amount of any support\n\nalimony arising in a prior case to the extent that\n\npayment is actually made,\n\nc. deducting from gross income any deductions as set\n\nforth for other prior-born or after-born children for\n\nwhom the parent is legally responsible and is actually\n\nsupporting, pursuant to Section 118C of this title,\n\nand\n\nd. deducting the amount of reasonable expenses of the\n\nparties attributable to debt service for preexisting,\n\njointly acquired debt of the parents;\n\n2. \"Base child support obligation\" means the amount of support\n\ndisplayed on the Schedule of Basic Child Support Obligations which\n\ncorresponds to the combined AGI of both parents and the number of\n\nchildren for whom support is being determined. This amount is\n\nrebuttably presumed to be the appropriate amount of basic child\n\nsupport to be provided by both parents in the case immediately under\n\nconsideration, prior to consideration of any adjustments for medical\n\nand child care costs, and any other additional expenses;\n\n3. \"Current monthly child support obligation\" means the base\n\nchild support obligation and the proportional share of any health\n\ncare coverage, cash medical support and annualized child care costs;\n\n4. \"Custodial person\" means a parent or third-party caretaker\n\nwho has physical custody of a child more than one hundred eighty-two\n\n(182) days per year;\n\n5. \"Incarceration\" means an obligor is in custody on a full-\n\ntime basis in a local, state or federal correctional facility.\n\nIncarceration shall not include probation, parole, work release or\n\nany other detention alternative program that allows the obligor to\n\nbe gainfully employed;\n\n6. \"Noncustodial parent\" means a parent who has physical\n\ncustody of a child one hundred eighty-two (182) days per year or\n\nless;\n\n7. \"Obligor\" means the person who is required to make payments\n\nunder an order for support;\n\n8. \"Obligee\" or \"person entitled\" means:\n\na. a person to whom a support debt or support obligation\n\nis owed,\n\nb. the Department of Human Services or a public agency of\n\nanother state that has the right to receive current or\n\naccrued support payments or that is providing support\n\nenforcement services, or\n\nc. a person designated in a support order or as otherwise\n\nspecified by the court;\n\n9. \"Other contributions\" means recurring monthly medical\n\nexpenses and visitation transportation costs that are not included\n\nin the current monthly child support obligation;\n\n10. \"Overnight\" means the child is in the physical custody and\n\ncontrol of a parent for an overnight period of at least twelve (12)\n\nhours, and that parent has made a reasonable expenditure of\n\nresources for the care of the child;\n\n11. \"Parent\" means an individual who has a parent-child\n\nrelationship under the Uniform Parentage Act;\n\n12. \"Parenting time adjustment\" means an adjustment to the base\n\nchild support amount based upon parenting time; and\n\n13. \"Payor\" means any person or entity paying monies, income,\n\nor earnings to an obligor.
