The district or administrative court shall determine the\n\nactual annualized child care expenses reasonably necessary to enable\n\neither or both parents to:\n\n1. Be employed;\n\n2. Seek employment; or\n\n3. Attend school or training to enhance employment income.\n\nB. When a parent is participating in the Department of Human\n\nServices child care subsidy program as provided under Section 230.50\n\nof Title 56 of the Oklahoma Statutes, the Child Care\n\nEligibility/Rates Schedule established by the Department shall be\n\nused. The actual child care costs incurred shall be the family\n\nshare copayment amount indicated on the schedule which shall be\n\nallocated and paid monthly in the same proportion as base child\n\nsupport. The Department of Human Services shall promulgate rules,\n\nas necessary, to implement the provisions of this section.\n\nC. The actual annualized child care costs incurred for the\n\npurposes authorized by this section shall be allocated and added to\n\nthe base child support order and shall be part of the final child\n\nsupport order.\n\nD. The district or administrative court shall require the\n\nparent incurring child care expenses to notify the obligor within\n\nforty-five (45) days of any change in the amount of the child care\n\ncosts that would affect the annualized child care amount as\n\ndetermined in the order.\n\nE.
