Stat. tit. 43, § 43-150.8","heading":"Court-ordered visitation - Appearance at hearing -","body":"Rebuttable presumptions.\n\nA. If the deploying parent moves to designate a family member\n\nor another person with a close and substantial relationship with the\n\nchild to exercise visitation rights, the court shall grant\n\nreasonable visitation to a member of the family of the child,\n\nincluding a stepparent or step sibling, with whom the child has a\n\nclose and substantial relationship as defined in the Deployed\n\nParents Custody and Visitation Act.\n\nB. Any visitation ordered by the court pursuant to this section\n\nshall be temporary in nature and shall not exceed or be less than\n\nthe amount of custodial time granted to the deploying parent under\n\nany existing permanent order or agreement between the parents, with\n\nthe exception that the court may take into account unusual travel\n\ntime required to transport the child between the nondeploying parent\n\nand the family members allowed visitation.\n\nC. The person designated by the deploying parent to exercise\n\nvisitation shall appear at the temporary order hearing.\n\nD. Rebuttable presumptions for proceedings under the Deployed\n\nParents Custody and Visitation Act:\n\n1. In postdissolution proceedings, there shall be a rebuttable\n\npresumption that it is in the best interests of the child for a\n\nstepparent to exercise the deployed parent’s parental duties;\n\n2. There shall be a rebuttable presumption that if the person\n\ndesignated by the deployed or deploying party meets the requirements\n\nof subsection A of this section, then it shall be in the best\n\ninterest of the child that the person receive visitation; and\n\n3. There shall be a rebuttable presumption that visitation by a\n\nfamily member who has perpetrated domestic violence against a\n\nspouse, a child, a domestic living partner, or is otherwise subject\n\nto registration requirements of the Sex Offenders Registration Act\n\nis not in the best interest of the child.\n\nE.
