Stat. tit. 43, § 43-551-102","heading":"Definitions","body":"DEFINITIONS\n\nIn this act:\n\n1. \"Abandoned\" means left without provision for reasonable and\n\nnecessary care or supervision;\n\n2. \"Child\" means an individual who has not attained eighteen\n\n(18) years of age;\n\n3. \"Child custody determination\" means a judgment, decree, or\n\nother order of a court providing for the legal custody, physical\n\ncustody, or visitation with respect to a child. The term includes a\n\npermanent, temporary, initial, and modification order. The term\n\ndoes not include an order relating to child support or other\n\nmonetary obligation of an individual;\n\n4. \"Child custody proceeding\" means a proceeding in which legal\n\ncustody, physical custody, or visitation with respect to a child is\n\nan issue. The term includes a proceeding for divorce, separation,\n\nneglect, abuse, dependency, guardianship, paternity, termination of\n\nparental rights, and protection from domestic violence, in which the\n\nissue may appear. The term does not include a proceeding involving\n\njuvenile delinquency, contractual emancipation, or enforcement under\n\nArticle 3 of this act;\n\n5. \"Commencement\" means the filing of the first pleading in a\n\nproceeding;\n\n6. \"Court\" means an entity authorized under the law of a state\n\nto establish, enforce, or modify a child custody determination;\n\n7. \"Home state\" means the state in which a child lived with a\n\nparent or a person acting as a parent for at least six (6)\n\nconsecutive months immediately before the commencement of a child\n\ncustody proceeding. In the case of a child less than six (6) months\n\nof age, the term means the state in which the child lived from birth\n\nwith the parent or person acting as a parent. A period of temporary\n\nabsence of the parent or person acting as a parent is part of the\n\nperiod;\n\n8. \"Initial determination\" means the first child custody\n\ndetermination concerning a particular child;\n\n9. \"Issuing court\" means the court that makes a child custody\n\ndetermination for which enforcement is sought under this act;\n\n10. \"Issuing state\" means the state in which a child custody\n\ndetermination is made;\n\n11. \"Modification\" means a child custody determination that\n\nchanges, replaces, supersedes, or is otherwise made after a previous\n\ndetermination concerning the same child, whether or not it is made\n\nby the court that made the previous determination;\n\n12. \"Person\" means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company, association,\n\njoint venture, government, including any governmental subdivision,\n\nagency, instrumentality, or public corporation, or any other legal\n\nor commercial entity;\n\n13. \"Person acting as a parent\" means a person, other than a\n\nparent, who:\n\na. has physical custody of the child or has had physical\n\ncustody for a period of six (6) consecutive months,\n\nincluding any temporary absence, within one (1) year\n\nimmediately before the commencement of a child custody\n\nproceeding, and\n\nb. has been awarded legal custody by a court or claims a\n\nright to legal custody under the law of this state;\n\n14. \"Physical custody\" means the physical care and supervision\n\nof a child;\n\n15. \"State\" means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands, or any\n\nterritory or insular possession subject to the jurisdiction of the\n\nUnited States;\n\n16. \"Tribe\" means an Indian tribe or band, or Alaskan Native\n\nvillage, which is recognized by federal law or formally acknowledged\n\nby a state; and\n\n17. \"Warrant\" means an order issued by a court authorizing law\n\nenforcement officers to take physical custody of a child.","path":["OK Code","Title 43"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4ccdf1697f08577338191d9b6a171f3a71e83ebed89bd462d04969f014823339","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43-43-551-101","next":"us-ok/okla.-stat.-tit.-43-43-551-103"},"notice":"GroundRules: Original legal text.
