Stat. tit. 43, § 43-551-308","heading":"Expedited enforcement of child custody determination","body":"EXPEDITED ENFORCEMENT OF CHILD CUSTODY DETERMINATION\n\nA. A petition under this article must be verified. Certified\n\ncopies of all orders sought to be enforced and of any order\n\nconfirming registration must be attached to the petition. A copy of\n\na certified copy of an order may be attached instead of the\n\noriginal.\n\nB. A petition for enforcement of a child custody determination\n\nmust state:\n\n1. Whether the court that issued the determination identified\n\nthe jurisdictional basis it relied upon in exercising jurisdiction\n\nand, if so, what the basis was;\n\n2. Whether the determination for which enforcement is sought\n\nhas been vacated, stayed, or modified by a court whose decision must\n\nbe enforced under this act and, if so, identify the court, the case\n\nnumber, and the nature of the proceeding;\n\n3. Whether any proceeding has been commenced that could affect\n\nthe current proceeding, including proceedings relating to domestic\n\nviolence, protective orders, termination of parental rights, and\n\nadoptions and, if so, identify the court, the case number, and the\n\nnature of the proceeding;\n\n4. The present physical address of the child and the\n\nrespondent, if known;\n\n5. Whether relief in addition to the immediate physical custody\n\nof the child and attorney's fees is sought, including a request for\n\nassistance from law enforcement officials and, if so, the relief\n\nsought; and\n\n6. If the child custody determination has been registered and\n\nconfirmed under Section 27 of this act, the date and place of\n\nregistration.\n\nC. Upon the filing of a petition, the court shall issue an\n\norder directing the respondent to appear in person with or without\n\nthe child at a hearing and may enter any order necessary to ensure\n\nthe safety of the parties and the child. The hearing must be held\n\non the judicial day after service of the order unless that date is\n\nimpossible. In that event, the court shall hold the hearing on the\n\nfirst judicial day possible. The court may extend the date of\n\nhearing at the request of the petitioner.\n\nD. An order issued under subsection C of this section must\n\nstate the time and place of the hearing and advise the respondent\n\nthat at the hearing the court will order that the petitioner may\n\ntake immediate physical custody of the child and the payment of\n\nfees, costs, and expenses under Section 34 of this act, and may\n\nschedule a hearing to determine whether further relief is\n\nappropriate, unless the respondent appears and establishes that:\n\n1. The child custody determination has not been registered and\n\nconfirmed under Section 27 of this act and that:\n\na. the issuing court did not have jurisdiction under\n\nArticle 2 of this act,\n\nb. the child custody determination for which enforcement\n\nis sought has been vacated, stayed, or modified by a\n\ncourt having jurisdiction to do so under Article 2 of\n\nthis act, or\n\nc. the respondent was entitled to notice, but notice was\n\nnot given in accordance with the standards of Section\n\n8 of this act, in the proceedings before the court\n\nthat issued the order for which enforcement is sought;\n\nor\n\n2.
