Unless the court issues a temporary emergency order pursuant\n\nto Section 16 of this act, upon a finding that a petitioner is\n\nentitled to immediate physical custody of the child, the court shall\n\norder that the petitioner may take immediate physical custody of the\n\nchild unless the respondent establishes that:\n\n1. The child custody determination has not been registered and\n\nconfirmed under Section 27 of this act and that:\n\na. the issuing court did not have jurisdiction under\n\nArticle 2 of this act,\n\nb. the child custody determination for which enforcement\n\nis sought has been vacated, stayed, or modified by a\n\ncourt of a state having jurisdiction to do so under\n\nArticle 2 of this act, or\n\nc. the respondent was entitled to notice, but notice was\n\nnot given in accordance with the standards of Section\n\n8 of this act, in the proceedings before the court\n\nthat issued the order for which enforcement is sought;\n\nor\n\n2. The child custody determination for which enforcement is\n\nsought was registered and confirmed under Section 27 of this act,\n\nbut has been vacated, stayed, or modified by a court of a state\n\nhaving jurisdiction to do so under Article 2 of this act.\n\nB. The court shall award the fees, costs, and expenses\n\nauthorized under Section 34 of this act and may grant additional\n\nrelief, including a request for the assistance of law enforcement\n\nofficials, and set a further hearing to determine whether additional\n\nrelief is appropriate.\n\nC. If a party called to testify refuses to answer on the ground\n\nthat the testimony may be self-incriminating, the court may draw an\n\nadverse inference from the refusal.\n\nD.
