Stat. tit. 43, § 43-601-102","heading":"Definitions","body":"\n\nIn this act:\n\n1. \"Child\" means an individual, whether over or under the age\n\nof majority, who is or is alleged to be owed a duty of support by\n\nthe individual's parent or who is or is alleged to be the\n\nbeneficiary of a support order directed to the parent;\n\n2. \"Child support order\" means a support order for a child,\n\nincluding a child who has attained the age of majority under the law\n\nof the issuing state or foreign country;\n\n3. \"Convention\" means the Convention on the International\n\nRecovery of Child Support and Other Forms of Family Maintenance,\n\nconcluded at The Hague on November 23, 2007;\n\n4. \"Duty of support\" means an obligation imposed or imposable\n\nby law to provide support for a child, spouse or former spouse,\n\nincluding an unsatisfied obligation to provide support;\n\n5. \"Foreign country\" means a country, including a political\n\nsubdivision thereof, other than the United States, that authorizes\n\nthe issuance of support orders and:\n\na. which has been declared under the law of the United\n\nStates to be a foreign reciprocating country,\n\nb. which has established a reciprocal arrangement for\n\nchild support with this state as provided in Section\n\n601-308 of this title,\n\nc. which has enacted a law or established procedures for\n\nthe issuance and enforcement of support orders which\n\nare substantially similar to the procedures under this\n\nact, or\n\nd. in which the Convention is in force with respect to\n\nthe United States;\n\n6. \"Foreign support order\" means a support order of a foreign\n\ntribunal;\n\n7. \"Foreign tribunal\" means a court, administrative agency or\n\nquasi-judicial entity of a foreign country which is authorized to\n\nestablish, enforce or modify support orders or to determine\n\nparentage of a child. The term includes a competent authority under\n\nthe Convention;\n\n8. \"Home state\" means the state or foreign country in which a\n\nchild lived with a parent or a person acting as parent for at least\n\nsix (6) consecutive months immediately preceding the time of filing\n\nof a petition or comparable pleading for support and, if a child is\n\nless than six (6) months old, the state or foreign country in which\n\nthe child lived from birth with any of them. A period of temporary\n\nabsence of any of them is counted as part of the six-month or other\n\nperiod;\n\n9. \"Income\" includes earnings or other periodic entitlements to\n\nmoney from any source and any other property subject to withholding\n\nfor support under the law of this state;\n\n10. \"Income-withholding order\" means an order or other legal\n\nprocess directed to an obligor's employer or other debtor, as\n\ndefined by the income-withholding law of this state, to withhold\n\nsupport from the income of the obligor;\n\n11. \"Initiating tribunal\" means the tribunal of a state or\n\nforeign country from which a petition or comparable pleading is\n\nforwarded or in which a petition or comparable pleading is filed for\n\nforwarding to another state or foreign country;\n\n12. \"Issuing foreign country\" means the foreign country in\n\nwhich a tribunal issues a support order or a judgment determining\n\nparentage of a child;\n\n13. \"Issuing state\" means the state in which a tribunal issues\n\na support order or a judgment determining parentage of a child;\n\n14. \"Issuing tribunal\" means the tribunal that issues a support\n\norder or a judgment determining parentage of a child;\n\n15. \"Law\" includes decisional and statutory law and rules and\n\nregulations having the force of law;\n\n16. \"Obligee\" means:\n\na. an individual to whom a duty of support is or is\n\nalleged to be owed or in whose favor a support order\n\nor a judgment determining parentage of a child has\n\nbeen issued,\n\nb. a foreign country, state or political subdivision of a\n\nstate to which the rights under a duty of support or\n\nsupport order have been assigned or which has\n\nindependent claims based on financial assistance\n\"Obligee\" means:\n\na. an individual to whom a duty of support is or is\n\nalleged to be owed or in whose favor a support order\n\nor a judgment determining parentage of a child has\n\nbeen issued,\n\nb. a foreign country, state or political subdivision of a\n\nstate to which the rights under a duty of support or\n\nsupport order have been assigned or which has\n\nindependent claims based on financial assistance\n\nprovided to an individual obligee in place of child\n\nsupport,\n\nc. an individual seeking a judgment determining parentage\n\nof the individual's child, or\n\nd. a person that is a creditor in a proceeding under\n\nArticle 7;\n\n17. \"Obligor\" means an individual or the estate of a decedent\n\nthat:\n\na. owes or is alleged to owe a duty of support,\n\nb. is alleged but has not been adjudicated to be a parent\n\nof a child,\n\nc. is liable under a support order, or\n\nd. is a debtor in a proceeding under Article 7;\n\n18. \"Outside this state\" means a location in another state or a\n\ncountry other than the United States, whether or not the country is\n\na foreign country;\n\n19. \"Person\" means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company, association,\n\njoint venture, public corporation, government or governmental\n\nsubdivision, agency or instrumentality, or any other legal or\n\ncommercial entity;\n\n20. \"Record\" means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form;\n\n21. \"Register\" means to record or file in a tribunal of this\n\nstate a support order or judgment determining parentage of a child\n\nissued in another state or a foreign country;\n\n22. \"Registering tribunal\" means a tribunal in which a support\n\norder or judgment determining parentage of a child is registered;\n\n23. \"Responding state\" means a state in which a petition or\n\ncomparable pleading for support or to determine parentage of a child\n\nis filed or to which a petition or comparable pleading is forwarded\n\nfor filing from another state or a foreign country;\n\n24. \"Responding tribunal\" means the authorized tribunal in a\n\nresponding state or foreign country;\n\n25. \"Spousal support order\" means a support order for a spouse\n\nor former spouse of the obligor;\n\n26. \"State\" means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands or any\n\nterritory or insular possession under the jurisdiction of the United\n\nStates. The term includes an Indian nation or tribe;\n\n27. \"Support enforcement agency\" means a public official,\n\ngovernmental entity, or private agency authorized to:\n\na. seek enforcement of support orders or laws relating to\n\nthe duty of support,\n\nb. seek establishment or modification of child support,\n\nc. request determination of parentage of a child,\n\nd. attempt to locate obligors or their assets, or\n\ne. request determination of the controlling child support\n\norder;\n\n28. \"Support order\" means a judgment, decree, order, decision,\n\nor directive, whether temporary, final or subject to modification,\n\nissued in a state or foreign country for the benefit of a child, a\n\nspouse or a former spouse, which provides for monetary support,\n\nhealth care, arrearages, retroactive support or reimbursement for\n\nfinancial assistance provided to an individual obligee in place of\n\nchild support.
