Every adult having a mental illness as defined in\n\nSection 1-103 of this title who is under the care of a licensed\n\nmental health professional shall be informed by the licensed mental\n\nhealth professional or the mental health treatment facility that the\n\nconsumer has the right to designate a family member or other\n\nconcerned individual as a treatment advocate.\n\n2. The individual designated as a treatment advocate shall act\n\nat all times in the best interests of the consumer.\n\n3. The patient may change or revoke the designation of a\n\ntreatment advocate at any time and for any reason.\n\n4. The treatment advocate may participate in the treatment\n\nplanning and discharge planning of the consumer to the extent\n\nconsented to by the consumer and as permitted by law.\n\n5. A person holding the powers vested in a guardianship of the\n\nperson, a grant of general health care decision-making authority or\n\ndesignation of health care proxy contained in an advance directive\n\nfor health care, or a durable power of attorney with health care\n\ndecision-making authority shall be the treatment advocate for the\n\npatient by operation of law.\n\nB. 1. The Board of Mental Health and Substance Abuse Services\n\nshall promulgate rules for all facilities certified by the\n\nDepartment of Mental Health and Substance Abuse Services as to the\n\ndesign, contents, and maintenance of a treatment advocate consent\n\nform.\n\n2. The contents of the consent form, at a minimum, shall\n\ninclude a statement indicating that the treatment advocate\n\nunderstands that all mental health treatment information is\n\nconfidential and that the treatment advocate agrees to maintain\n\nconfidentiality.\n\nC.
