For purposes of this section:\n\n1. “Near death” means the vulnerable adult is in serious or\n\ncritical condition, as certified by a physician, as a result of\n\nabuse or neglect; and\n\n2. \"Vulnerable adult\" shall be defined as provided in Section\n\n10-103 of Title 43A of the Oklahoma Statutes.\n\nB. When a person responsible for the care of a vulnerable adult\n\nhas been charged by information or indictment with committing a\n\ncrime resulting in the death or near death of the vulnerable adult,\n\nthere shall be a presumption that the best interest of the public is\n\nserved by public disclosure of certain information concerning:\n\n1. The circumstances of the investigation of the death or near\n\ndeath of the vulnerable adult; and\n\n2. Any other investigations concerning that vulnerable adult,\n\nor other vulnerable adults living in the same facility, or involving\n\nan individual provider of services to vulnerable adults, within:\n\na. three (3) years of the death or near death, and\n\nb. one (1) year after the death or near death.\n\nC. 1. At any time subsequent to seven (7) days of the date the\n\nperson providing care to the vulnerable adult has been criminally\n\ncharged, the Department of Human Services Adult Protective Services\n\nDivision, the district attorney, the district court clerk, and the\n\njudge having jurisdiction over the case, upon request, shall release\n\ncertain information to the public as follows:\n\na. a confirmation shall be provided by the Department as\n\nto whether a report has been made concerning the\n\nalleged victim or other vulnerable adults while living\n\nin the same household or facility and whether an\n\ninvestigation has begun,\n\nb. confirmation shall be provided by the Department as to\n\nwhether previous reports have been made and the dates\n\nthereof, a summary of those previous reports, the\n\ndates and outcome of any investigations or actions\n\ntaken by the Department in response to a previous\n\nreport of abuse or neglect of vulnerable adults, and\n\nthe specific recommendation made to the district\n\nattorney and any subsequent action taken by the\n\ndistrict attorney,\n\nc. the dates of any judicial proceedings prior to the\n\ndeath or near death of the vulnerable adult,\n\nd. recommendations submitted by each participant in\n\nwriting at the judicial proceedings including\n\nrecommendation made at the hearing as they relate to\n\nappropriate placement of a vulnerable adult, and\n\ne. the rulings of the court.\n\n2. Specific recommendations made and services rendered by the\n\nDepartment of Human Services Adult Protective Services Division\n\ndescribed in any progress reports of a pending case submitted to the\n\ncourt may be disclosed by the Department.\n\nD. Any disclosure of information pursuant to this section shall\n\nnot identify or provide an identifying description of any\n\ncomplainant or reporter of vulnerable adult abuse or neglect, and\n\nshall not identify the name of other vulnerable adults in the\n\nhousehold or facility, the person responsible for the care of the\n\nvulnerable adult, or any other member of the facility or household,\n\nother than the person criminally charged.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d8861d55f568e77cfb3615d4b696c0ab8d25191150029c413e21abb73107e6f6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-10-110","next":"us-ok/okla.-stat.-tit.-43a-43a-10-111"},"notice":"GroundRules: Original legal text.
