The district courts are vested with jurisdiction to\n\nissue orders and enforce orders restricting visitation, by the\n\ncustodian or by any other person specified by the court, of a\n\nvulnerable adult who is receiving or has been determined to need\n\nprotective services pursuant to the Protective Services for\n\nVulnerable Adults Act.\n\n2. Whenever it is consistent with the welfare and safety of a\n\nvulnerable adult, the court shall restrict the visitation of a\n\ncustodian or other person specified by the court who is alleged or\n\nhas been determined to have abused, neglected or exploited the\n\nvulnerable adult.\n\n3. Notice as ordered by the court shall be given to the\n\ncustodian or other person alleged or determined to have abused,\n\nneglected or exploited a vulnerable adult.\n\nB. If the Department of Human Services determines, as a result\n\nof its investigation or an investigation by the Office of Client\n\nAdvocacy within the State Department of Health, that a vulnerable\n\nadult needs voluntary or involuntary protective services as a result\n\nof abuse, neglect or exploitation by the caretaker or by any other\n\nperson, the Department of Human Services may petition the district\n\ncourt to restrict the visitation of such custodian or other person\n\nwith the vulnerable adult.\n\nC. 1. Consistent with the welfare and safety of the vulnerable\n\nadult, the court may require supervised visitation, prohibit\n\nvisitation or otherwise limit the visitation by the custodian or\n\nsuch other person with the vulnerable adult.\n\n2. The basis for restricting visitation shall be stated in the\n\nrecord by the court.\n\nD. The owner, operator or any facility personnel of a nursing\n\nhome, residential home, assisted living facility or other long-term\n\ncare facility having reason to believe that visitation of a\n\nvulnerable adult should be restricted may notify the Office of the\n\nState Long-Term Care Ombudsman within the Office of the Attorney\n\nGeneral or the appropriate state entity.
