Stat. tit. 43A, § 43A-11-103","heading":"Definitions","body":"Whenever used in the Advance Directives for Mental Health\n\nTreatment Act:\n\n1. \"Advance directive for mental health treatment\" means a\n\nwritten document voluntarily executed by a declarant in accordance\n\nwith the requirements of this act and includes:\n\na. a declaration, or\n\nb. the appointment of an attorney-in-fact;\n\n2. \"Attending physician or psychologist\" means the physician or\n\npsychologist who has primary responsibility for the mental health\n\ntreatment of the declarant;\n\n3. \"Attorney-in-fact\" means an individual eighteen (18) years\n\nold or older appointed by a declarant to make mental health\n\ntreatment decisions on behalf of the declarant as provided by this\n\nact;\n\n4. \"Capable\" means the person is able to receive and evaluate\n\ninformation effectively and communicate decisions regarding his or\n\nher mental health treatment;\n\n5. \"Declaration\" means a written document voluntarily executed\n\nby a declarant stating the mental health treatment wishes of a\n\ndeclarant in the event the declarant is determined to be incapable\n\nand mental health treatment is necessary;\n\n6. \"Declarant\" means a capable person eighteen (18) years of\n\nage or older who has executed an advance directive for mental health\n\ntreatment in accordance with the provisions of this act;\n\n7. \"Health care facility\" includes any program, institution,\n\nplace, building or agency, or portion thereof, private or public,\n\nwhether organized for profit or not, used, operated, or designed to\n\nprovide medical diagnosis, treatment, rehabilitative or preventive\n\ncare to any person. The term \"health care facility\" includes, but\n\nis not limited to, health care facilities that are commonly referred\n\nto as hospitals, outpatient clinics, organized ambulatory health\n\ncare facilities, emergency care facilities and centers, health\n\nmaintenance organizations, and others providing similarly organized\n\nservices regardless of nomenclature;\n\n8. \"Mental health treatment\" means convulsive treatment,\n\ntreatment with psychoactive medication, and admission to and\n\nretention in a facility for a period up to twenty-eight (28) days;\n\n9. \"Physician\" means an individual currently licensed to\n\npractice medicine in this state;\n\n10. \"Psychologist\" means an individual currently licensed to\n\npractice in this state as a clinical psychologist; and\n\n11. \"Incapable\" means that, in the opinion of two persons, who\n\nshall be physicians or psychologists, a person's ability to receive\n\nand evaluate information effectively or communicate decisions is\n\nimpaired as the result of a mental illness to such an extent that\n\nthe person currently lacks the capacity to make mental health\n\ntreatment decisions.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b05c965d8e7a8806d47a4a02d876d81abe782f0534a1bcb72d892a19beef1af1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-11-102","next":"us-ok/okla.-stat.-tit.-43a-43a-11-104"},"notice":"GroundRules: Original legal text.
