An advance directive for mental health treatment is valid\n\nonly if it is signed by the declarant and two capable witnesses\n\neighteen (18) years of age or older. The witnesses shall attest\n\nthat the declarant:\n\n1. Is known to them;\n\n2. Signed the advance directive for mental health treatment in\n\ntheir presence;\n\n3. Appears to be capable; and\n\n4. Is not acting under duress, fraud or undue influence.\n\nB. None of the following persons shall be eligible to serve as\n\nattorney-in-fact to the signing of an advance directive for mental\n\nhealth treatment:\n\n1. The attending physician or psychologist or an employee of\n\nthe physician or psychologist; or\n\n2.
