Stat. tit. 43A, § 43A-11-108","heading":"Delivery of advance directive to attending physician","body":"or psychologist - Duty of attending physician or other mental health\n\ntreatment provider.\n\nA. It shall be the responsibility of the declarant to provide\n\nfor delivery of the advance directive for mental health treatment to\n\nthe attending physician or psychologist.\n\n1. In the event the declarant is comatose, incompetent, or\n\notherwise mentally or physically incapable after executing the\n\nadvance directive for mental health treatment, any other person may\n\ndeliver the advance directive for mental health treatment to the\n\nattending physician or psychologist.\n\n2. Any person having possession of another person’s advance\n\ndirective for mental health treatment and who becomes aware that the\n\ndeclarant is in circumstances under which the terms of the advance\n\ndirective for mental health treatment may become operative shall\n\ndeliver the advance directive for mental health treatment to the\n\ndeclarant’s attending physician, psychologist or to any health care\n\nfacility in which the declarant is a consumer.\n\nB. An attending physician, psychologist or health care facility\n\nnotified of the advance directive for mental health treatment of a\n\ndeclarant shall promptly make the declaration a part of the medical\n\nrecords of the declarant.\n\nC.
