An advance directive for mental health treatment may be\n\nrevoked in whole or in part by the declarant at any time while the\n\ndeclarant is capable by any of the following methods:\n\n1. By being destroyed by the declarant or by some person in the\n\ndeclarant's presence and at the declarant's direction;\n\n2. By a written revocation signed and dated by the declarant\n\nexpressing the declarant's intent to revoke;\n\n3. By a declarant's unambiguous verbal expression, in the\n\npresence of two witnesses eighteen (18) years of age or older, of an\n\nintent to revoke the declaration; or\n\n4. By a declarant's unambiguous verbal expression to an\n\nattending physician or psychologist.\n\nB. The revocation shall become effective upon communication to\n\nthe attending physician or psychologist by the declarant or by both\n\nwitnesses. The attending physician or psychologist shall record the\n\ntime, date, and place when the notification of the revocation was\n\nreceived.\n\nC. In the absence of actual notice of the revocation of an\n\nadvance directive for mental health treatment, no attending\n\nphysician or psychologist, health care facility or other person\n\nacting under the direction of an attending physician or psychologist\n\nshall be subject to criminal prosecution or civil liability or be\n\ndeemed to have engaged in unprofessional conduct as a result of the\n\nprovision of medical treatment to a declarant in accordance with the\n\nAdvance Directives for Mental Health Treatment Act unless the\n\nabsence of actual notice resulted from the negligence of the health\n\ncare provider, physician, or other person.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"64d4f3f32c6e8bb4805a5d4ab3823d229c43a93e636203e7d755bdb5c325809e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-11-108","next":"us-ok/okla.-stat.-tit.-43a-43a-11-110"},"notice":"GroundRules: Original legal text.
