The purpose of the Oklahoma Elder Exploitation and Abuse Act\n\nis to promote the general welfare of all citizens by establishing a\n\ncivil action for incapacitated persons and vulnerable adults which\n\nprovides for the protection of their rights and affords them a right\n\nof civil action against those who neglect, exploit, or abuse them.\n\nB. The purpose of the Oklahoma Elder Exploitation and Abuse Act\n\nis to allow incapacitated persons and vulnerable adults, through\n\ntheir legal representatives, to pursue claims against persons who\n\nneglect, exploit, or abuse the incapacitated person or vulnerable\n\nadult if he or she lacks the capacity to pursue such claims on his\n\nor her own behalf.\n\nC. The Oklahoma Elder Exploitation and Abuse Act does not\n\npreclude an individual's mandatory responsibility to report to Adult\n\nProtective Services or law enforcement if there is reasonable cause\n\nto believe a vulnerable adult is being abused, neglected, or\n\nexploited.\n\nD. It is the intent of the Oklahoma Legislature:\n\n1. That the district court shall exercise the authority\n\nconferred by the Oklahoma Elder Exploitation and Abuse Act to\n\nencourage the development of maximum self-reliance and independence\n\nof incapacitated persons and vulnerable adults and make appointive\n\nand other orders only to the extent necessitated by the mental and\n\nadaptive limitations of other conditions of the incapacitated or\n\npartially incapacitated person warranting the action; and\n\n2. That in performing their duties and exercising their powers,\n\nlegal representatives bringing claims under this act for\n\nincapacitated persons and vulnerable adults shall:\n\na. assure, to the extent reasonably possible, that the\n\nrights of the persons for whom they are appointed are\n\nprotected, and\n\nb. encourage, to the extent reasonably possible,\n\nincapacitated persons and vulnerable adults to\n\nparticipate to the maximum extent of their abilities\n\nin all decisions which affect them concerning the\n\nclaims afforded them under this act.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"66a643d23b37ecfc3eb8958b5258de228389bae15f6644d8115e355d4e4ddb5b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-14-101","next":"us-ok/okla.-stat.-tit.-43a-43a-14-103"},"notice":"GroundRules: Original legal text.
