Stat. tit. 43A, § 43A-2-101","heading":"Department of Mental Health and Substance Abuse","body":"Services - Board of Mental Health and Substance Abuse Services.\n\nA. 1. There is hereby established in this state a Department\n\nof Mental Health and Substance Abuse Services.\n\n2. This Department's governing board shall be the Board of\n\nMental Health and Substance Abuse Services, and its chief executive\n\nofficer shall be the Commissioner of Mental Health and Substance\n\nAbuse Services. The Commissioner shall be appointed by the Governor\n\nwith the advice and consent of the Senate and shall serve at the\n\npleasure of the Governor and may be removed or replaced without\n\ncause. Compensation for the Commissioner shall be determined by the\n\nGovernor. The Commissioner may be removed from office by a two-\n\nthirds (2/3) vote of the members elected to and constituting each\n\nchamber of the Legislature.\n\n3. The Department of Mental Health and Substance Abuse Services\n\nshall exercise all functions of the state in relation to the\n\nadministration and operation of all state facilities for the care\n\nand treatment of the mentally ill and drug- or alcohol-dependent\n\npersons.\n\nB.
