There is hereby created in the State Treasury a\n\nrevolving fund for the Department of Mental Health and Substance\n\nAbuse Services to be designated the \"Capital Outlay Fund\". The fund\n\nshall be a continuing fund, not subject to fiscal year limitations,\n\nand shall consist of income as provided in this section and any\n\nmonies transferred by the Department into the fund.\n\n2. All monies accruing to the credit of the fund are hereby\n\nappropriated and may be budgeted and expended by the Department for\n\nthe purposes described in this section and for improvements to real\n\nproperty owned by the Department or held in the Department's trust\n\nas authorized by Section 2-111 of this title. Expenditures from the\n\nfund shall be made upon warrants issued by the State Treasurer\n\nagainst claims filed as prescribed by law with the Director of the\n\nOffice of Management and Enterprise Services for approval and\n\npayment.\n\nB. On and after July 1, 1988, no easement, right-of-way, oil\n\nand gas lease or surface lease on any land used or occupied by any\n\ninstitution, under the jurisdiction of the Board of Mental Health\n\nand Substance Abuse Services, shall be granted or conveyed without\n\nthe approval of the Board. All monies hereafter received or derived\n\nfrom such easements, rights-of-way and leases, including, but not\n\nlimited to, rentals and royalties for leases and from sale of\n\nequipment, shall be deposited in the Capital Outlay Fund of the\n\nDepartment of Mental Health and Substance Abuse Services and used by\n\nthe Board for capital improvement at any Department of Mental Health\n\nand Substance Abuse Services facility and for improvements to real\n\nproperty owned by the Department or held in the Department's trust\n\nas authorized by Section 2-111 of this title, except as otherwise\n\nprovided by the Legislature.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2724e1cb8df3f710fbd4bbad32a0b860eeb0bfe5c09d5154ca647f2d23128e4d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-2-106","next":"us-ok/okla.-stat.-tit.-43a-43a-2-108"},"notice":"GroundRules: Original legal text.
