The Board of Mental Health and Substance Abuse Services\n\nis hereby authorized and directed to create a trust into which all\n\nreal property held by or for the benefit of the Department of Mental\n\nHealth and Substance Abuse Services shall be transferred.\n\n2. The trust shall provide that:\n\na. the property placed into the trust may never be sold,\n\nexcept for the tracts specifically described in\n\nsubparagraph c of this paragraph, if it is determined\n\nby the trustees for the Department's Real Property\n\nTrust and by the Department that such a sale is in the\n\nbest interests of the Department, and then the\n\nproceeds shall be used exclusively for tangible\n\ninfrastructure improvements that benefit the persons\n\nserved by the Department. The provisions of 61 O.S.\n\nSection 327 do not apply to the sale of real property\n\nunder this section, otherwise the property shall be\n\nheld in perpetuity for the sole benefit of the\n\nDepartment,\n\nb. the property held by the trust which is not needed for\n\nuse by the Department may be leased or rented to\n\nothers and all income received from such leases or\n\nrentals shall be payable to the Department for use by\n\nthe Department to fulfill the purposes of the\n\nDepartment, except as provided in subparagraph d of\n\nthis section,\n\nc. the following tract or tracts of land may be sold as\n\nset forth in subparagraph a of this paragraph:\n\n(1) Land owned by the Department located in Sections\n\n20 and 29, Township 9 North, Range 2 West,\n\nCleveland County, Oklahoma,\n\n(2) Land owned by the Department located in Block 5\n\nof Culbertson Heights Addition to the City of\n\nOklahoma City, Oklahoma County, Oklahoma,\n\n(3) Land owned by the Department located in Section\n\n27, Township 9 North, Range 2 West, Cleveland\n\nCounty, Oklahoma,\n\n(4) Land owned by the Department located in Section\n\n20, Township 20 North, Range 13 East and\n\ndescribed as PRT NW NW BEG 659.68 Feet South \u0026\n\n310.67 Feet East NWC NW, thence North 142.64\n\nFeet, NE 150 Feet, NW 140 Feet to point on South\n\nLine Mohawk Blvd, NE 300 Feet, SE 187.75 Feet,\n\nEast 204.92 Feet to point 405 West of East Line\n\nNW, thence South 355.89 Feet to point on North\n\nLine Atlanta Circle ADD, thence West 604.06 to\n\nPoint of Beginning, 5.16 acres More or Less in\n\nTulsa County, Oklahoma,\n\n(5) Land owned by the Department located in all that\n\npart of the North Half of the Northwest Quarter\n\nof the Northwest Quarter (N/2 NW1/4 NW1/4) of\n\nSection 20, Township 20 North, Range 13 East of\n\nthe Indian Base and Meridian, Tulsa County, State\n\nof Oklahoma, according to the United States\n\nGovernment Survey thereof, being more\n\nparticularly described as BEGINNING at the\n\nNortheast corner of such NW/4 NW/4; thence West\n\nalong the North line of such NW/4, a distance of\n\n405 feet to a point; thence South and parallel to\n\nthe East line of such NW/4, a distance of 615.53\n\nfeet to a point; thence East and parallel to the\n\nNorth line of such NW/4, a distance of 405 feet\n\nto a point in the East line of such NW/4 NW/4,\n\nand such point being 615.53 feet South of the\n\nNortheast corner of such NW/4 NW/4; thence North\n\nalong the East line of such NW/4 NW/4 a distance\n\nof 615.53 feet to a Point and Place of the\n\nBeginning,\n\n(6) Land owned by the Department located in Lots 13\n\nthrough 24, Inclusive Block 5 and Bath Orchard\n\nAddition to Oklahoma City, SE 1/4 of Section 26,\n\nTownship 12 North, Range 3 West, and\n/4 NW/4,\n\nand such point being 615.53 feet South of the\n\nNortheast corner of such NW/4 NW/4; thence North\n\nalong the East line of such NW/4 NW/4 a distance\n\nof 615.53 feet to a Point and Place of the\n\nBeginning,\n\n(6) Land owned by the Department located in Lots 13\n\nthrough 24, Inclusive Block 5 and Bath Orchard\n\nAddition to Oklahoma City, SE 1/4 of Section 26,\n\nTownship 12 North, Range 3 West, and\n\n(7) Land owned by the Department located in a portion\n\nof Block 2 in Warr Acres, Oklahoma and described\n\nas SE 1/4, SE 1/4 of Section 9, Township 12\n\nNorth, Range 4 West, and\n\nd. under no condition should any real property held in\n\ntrust be sold to fund prevention, mental health or\n\naddiction treatment services.\n\nB. Upon the creation of the trust authorized in subsection A of\n\nthis section, the Office of Management and Enterprise Services is\n\ndirected to provide all necessary assistance to the Department of\n\nMental Health and Substance Abuse Services to identify and transfer\n\nall property held by or for the benefit of the Department of Mental\n\nHealth and Substance Abuse Services to the trust. Except as\n\nprovided in subsection C of this section, the Office of Management\n\nand Enterprise Services is authorized and directed to provide all\n\nrequested assistance to the Department of Mental Health and\n\nSubstance Abuse Services in leasing property placed in such trust.\n\nC.
