Stat. tit. 43A, § 43A-3-306","heading":"Board of Mental Health and Substance Abuse Services -","body":"Responsibilities and authority.\n\nA. The Board of Mental Health and Substance Abuse Services\n\nshall have the responsibility and authority to:\n\n1. Promulgate rules governing eligibility of public agencies or\n\nmental health facilities to contract with the Department of Mental\n\nHealth and Substance Abuse Services;\n\n2. Prescribe standards for qualifications of personnel and\n\nquality of professional services;\n\n3. Ensure eligibility for community mental health services so\n\nthat no person will be denied services on the basis of race, color\n\nor creed or inability to pay; and\n\n4. Promulgate such other rules as may be necessary to carry out\n\nthe provisions of the Unified Community Mental Health Services Act.\n\nB. The Department shall have the following responsibilities and\n\nauthority to:\n\n1. Provide technical assistance to community mental health\n\nfacilities and boards;\n\n2. Provide clinical, fiscal and management audit of services\n\nand facilities;\n\n3. Approve and compile catchment area plans and budget requests\n\ninto a statewide mental health plan and budget for submission to the\n\nGovernor, Legislature and federal funding sources as appropriate;\n\nand\n\n4.
