Stat. tit. 43A, § 43A-3-315","heading":"Certification as community residential mental health","body":"programs.\n\nA. The Board of Mental Health and Substance Abuse Services\n\nshall adopt minimum standards for program certification for\n\nresidential care homes operating as community residential mental\n\nhealth programs as provided in this section. The standards shall be\n\nadopted as rules and promulgated by the Board of Mental Health and\n\nSubstance Abuse Services pursuant to the provisions of the\n\nAdministrative Procedures Act.\n\nB. The program certification standards adopted by the Board\n\nshall provide for a system of classification of community\n\nresidential mental health programs based upon the level of care\n\nrequired by residents of the facility and establish minimum program\n\ncertification standards for each classification. The program\n\ncertification standards adopted by the Board for each classification\n\nshall be such that residential care facilities having a valid\n\ncontract with the Department and licensed by the State Department of\n\nHealth on July 1, 1988, shall be qualified and eligible for program\n\ncertification within an appropriate classification.\n\nC. The Department shall terminate the contract of any home that\n\nfails to meet contract provisions regarding financial statements.\n\nD. The Department of Mental Health and Substance Abuse Services\n\nis authorized to establish and collect certification and renewal\n\nfees for certification of community residential mental health\n\nfacilities and programs as provided in Section 3-324 of this title.\n\nE.
