The Board of Mental Health and Substance Abuse Services\n\nshall promulgate rules and standards for certification of gambling\n\naddiction treatment programs and for private facilities and\n\norganizations which offer gambling addiction treatment services in\n\nthis state. These facilities and organizations shall be known as\n\n“Certified Gambling Addiction Treatment Programs”.\n\nB. Applications for certification as a certified gambling\n\naddiction treatment program, pursuant to the provisions of this\n\nsection, shall be made to the Department of Mental Health and\n\nSubstance Abuse Services on prescribed forms. The Board, or the\n\nCommissioner of Mental Health and Substance Abuse Services upon\n\ndelegation by the Board, may certify the program for a period of\n\nthree (3) years, subject to renewal as provided in rules promulgated\n\nby the Board. Nothing in this section shall preclude the Department\n\nfrom making inspection visits to a program to determine program\n\ncompliance.\n\nC. Hospitals licensed by the State Department of Health shall\n\nbe exempt from certification requirements. In addition, licensed\n\nphysicians, licensed psychologists, licensed social workers,\n\nindividual members of the clergy, licensed marital and family\n\ntherapists, registered nurses, licensed behavioral practitioners,\n\nand licensed professional counselors shall be exempt from\n\ncertification requirements; provided, however, these exemptions\n\nshall only apply to individual professional persons in their private\n\npractices and not to any gambling addiction treatment program\n\noperated by the person.\n\nD. Facilities providing services for gambling addiction shall\n\ncomply with standards promulgated by the Board; provided, that the\n\ncertification requirements and standards shall not apply to programs\n\nand services offered by other state agencies. The gambling\n\naddiction treatment programs certified pursuant to the provisions of\n\nthis section shall cooperate with inspection personnel of the state\n\nand shall promptly file all reports required by the Department.\n\nFailure to comply with rules and standards of the Board shall be\n\nground for revocation of certification, after proper notice and\n\nhearing.\n\nE. The Department of Mental Health and Substance Abuse Services\n\nis authorized to establish and collect certification and renewal\n\nfees for certification of gambling addiction treatment programs as\n\nprovided in Section 3-324 of this title.\n\nF. Failure to comply with rules and standards promulgated by\n\nthe Board shall be grounds for revocation, suspension or nonrenewal\n\nof certification.\n\nG.
