The Board of Mental Health and Substance Abuse Services\n\nshall promulgate rules and standards for certification of Problem\n\nGambling Treatment Counselors who are:\n\n1. Employed by the state;\n\n2. Employed by behavioral services providers contracting with\n\nthe state to provide behavioral health services;\n\n3. Employed by a tribe or tribal facility that provides\n\nbehavioral health services; or\n\n4. Employed by an Oklahoma Department of Veterans Affairs or a\n\nUnited States Department of Veterans Affairs facility.\n\nB. Such rules and standards shall address criteria for\n\ncertification and renewal, including minimum education requirements,\n\nexamination and supervision requirements, continuing education\n\nrequirements, and rules of professional conduct.\n\nC. Application for certification as a Problem Gambling\n\nTreatment Counselor shall be made to the Department of Mental Health\n\nand Substance Abuse Services on prescribed forms authorized by the\n\nDepartment. The Board, or the Commissioner of Mental Health and\n\nSubstance Abuse Services upon delegation by the Board, may certify\n\nthe Problem Gambling Treatment Counselor for a period of two (2)\n\nyears subject to renewal as provided in the rules promulgated by the\n\nBoard.\n\nD. The Board is authorized to establish an application and\n\nrenewal fee of no more than One Hundred Dollars ($100.00) to defray\n\nthe costs incurred in the certification process.\n\nE. Problem Gambling Treatment Counselors certified by the Board\n\nor the Commissioner shall only use the title \"Problem Gambling\n\nTreatment Counselor\" if employed by the state, employed by\n\nbehavioral services providers contracting with the state to provide\n\nbehavioral health services, employed by a tribe or tribal facility\n\nthat provides behavioral health services or employed by an Oklahoma\n\nDepartment of Veterans Affairs or a United States Department of\n\nVeterans Affairs facility.\n\nF. This section shall not be construed to permit the certified\n\nProblem Gambling Treatment Counselor to practice any of the\n\nfollowing professions or use the following titles unless also\n\nlicensed or accredited by the appropriate authority:\n\n1. Physician;\n\n2. Psychologist;\n\n3. Clinical social worker;\n\n4. Professional counselor;\n\n5. Marital and family therapist;\n\n6. Behavioral practitioner; or\n\n7. Alcohol and drug counselor.\n\nG. Failure to comply with the rules and standards promulgated\n\nby the Board shall be grounds for revocation, suspension or\n\nnonrenewal of certification.\n\nH.
