As used in this section:\n\n1. \"Board\" means any of the following:\n\na. the State Board of Examiners of Psychologists,\n\nb. the State Board of Behavioral Health Licensure,\n\nc. the Oklahoma State Board of Licensed Social Workers,\n\nor\n\nd. the Oklahoma Board of Licensed Alcohol and Drug\n\nCounselors;\n\n2. \"Licensed mental health professional\" means an individual\n\nwho holds any type of license pursuant to the:\n\na. Psychologists Licensing Act,\n\nb. Psychology Interjurisdictional Compact,\n\nc. Licensed Professional Counselors Act,\n\nd. Janet Phillips Act of 2023,\n\ne. Marital and Family Therapist Licensure Act,\n\nf. Social Worker's Licensing Act, or\n\ng. Licensed Alcohol and Drug Counselors Act; and\n\n3. \"Certified mental health professional\" means an individual\n\nwho holds any type of certification pursuant to the Unified\n\nCommunity Mental Health Services Act.\n\nB. Every applicant for a behavioral health certification or\n\nlicense issued by a designated board shall provide the following\n\ninformation:\n\n1. Demographic information, including race, ethnicity, gender,\n\ndate of birth, and languages spoken;\n\n2. Educational background, training information, internship\n\ninformation, if applicable, and location of internship or program\n\nattended; and\n\n3. If the applicant has any other mental health certifications\n\nor licenses.\n\nC. Every mental health professional who is renewing a\n\nbehavioral health certification or license issued by a designated\n\nboard shall report the following information:\n\n1. Changes to demographic information required upon initial\n\napplication for licensure or certification;\n\n2. Workforce retention information, including, but not limited\n\nto, anticipated changes in licensure status or retirement; and\n\n3. Workforce practice trends, including, but not limited to:\n\na. practice specialization, if applicable,\n\nb. practice location and physical address, if applicable,\n\nc. service delivery area, by county,\n\nd. if the licensee is currently using their license and\n\nif its average use is between one (1) through ten\n\n(10), eleven (11) through twenty (20), twenty-one (21)\n\nthrough thirty (30), or over thirty-one (31) hours of\n\nclient-facing hours per week, and\n\ne. the use of telehealth.\n\nD. The boards designated in subsection A of this section shall\n\npromulgate rules to effectuate the provisions of this section.\n\nE. The boards designated in subsection A of this section shall\n\nfurnish de-identified annual licensure and certification data to the\n\nOklahoma Department of Mental Health and Substance Abuse Services.\n\nF. The Oklahoma Department of Mental Health and Substance Abuse\n\nServices shall compile the de-identified information collected in\n\nthis section into an annual report. The report shall not contain\n\nany personal identifying information. The annual report shall be\n\nposted on the agency's website and submitted to the President Pro\n\nTempore of the Oklahoma State Senate, the Speaker of the Oklahoma\n\nHouse of Representatives, and the chairs of the committees with\n\nresponsibility over public health in both chambers of the\n\nLegislature.\n\nG.
