Stat. tit. 43A, § 43A-3-403","heading":"Definitions","body":"As used in the Oklahoma Alcohol and Drug Abuse Services Act:\n\n1. \"Approved treatment facility\" means any facility which:\n\na. offers either inpatient, intermediate or outpatient\n\ntreatment to any person suffering from alcohol or drug\n\nabuse, or alcohol- or drug-related problems, and\n\nb. is certified by the Board of Mental Health and\n\nSubstance Abuse Services;\n\n2. An \"alcohol-dependent person\" is one who uses alcoholic\n\nbeverages to such an extent that it impairs the health, family life,\n\nor occupation of the person and compromises the health and safety of\n\nthe community;\n\n3. A \"drug-dependent person\" means a person who is using a\n\ncontrolled substance as presently defined in Section 102 of the\n\nFederal Controlled Substances Act and who is in a state of psychic\n\nor physical dependence, or both, arising from administration of that\n\ncontrolled substance on an intermittent or continuous basis. Drug\n\ndependence is characterized by behavioral and other responses which\n\ninclude a strong compulsion to take the substance on a continuous\n\nbasis in order to experience its psychic effects, or to avoid the\n\ndiscomfort of its absence;\n\n4. \"Intoxicated person\" means a person whose mental or physical\n\nfunctioning is substantially impaired as the direct result of the\n\nconsumption of alcohol or drugs;\n\n5. \"Medical detoxification\" means diagnostic and treatment\n\nservices performed by licensed facilities for acute alcohol\n\nintoxication, delirium tremens and physical and neurological\n\ncomplications resulting from acute intoxication. Medical\n\ndetoxification includes the services of a physician and attendant\n\nmedical personnel including nurses, interns and emergency room\n\npersonnel, the administration of a medical examination and a medical\n\nhistory, the use of an emergency room and emergency medical\n\nequipment if warranted, a general diet of three meals each day, the\n\nadministration of appropriate laboratory tests, and supervision by\n\nproperly trained personnel until the person is no longer medically\n\nincapacitated by the effects of alcohol;\n\n6. \"Nonmedical detoxification\" means detoxification services\n\nfor intoxicated clients with no apparent physical or neurological\n\nsymptoms requiring medical treatment as a result of their\n\nintoxication. Nonmedical detoxification includes providing a bed,\n\noral administration of fluids, three meals a day and the taking of\n\nthe client's temperature, blood pressure and pulse at least once\n\nevery six (6) hours for the duration of the client's stay in the\n\nnonmedical detoxification service;\n\n7. \"Inpatient treatment\" means the process of providing\n\nresidential diagnostic and treatment services on a scheduled basis;\n\n8. \"Intermediate care\" means an organized therapeutic\n\nenvironment in which a client may receive diagnostic services,\n\ncounseling, vocational rehabilitation and/or work therapy while\n\nbenefiting from the support which a full or partial residential\n\nsetting can provide. Intermediate care should provide a transition\n\nbetween the inpatient detoxification facility and reintegration into\n\ncommunity life. Intermediate care must include provision for a bed,\n\nthree meals a day and medical support if needed;\n\n9. \"Transitional living facility\" and \"halfway house\" means an\n\napproved treatment facility which offers or provides temporary\n\nresidential accommodations, meals, supervision at all times\n\nresidents are in the facility or on facility premises, and services,\n\nincluding counseling, short-term supportive care, case management,\n\nmental health services or treatment services. The terms do not\n\ninclude residential substance abuse centers which are facilities\n\nthat provide treatment for consumers in a live-in setting that\n\nprovides a regimen consisting of twenty-four (24) treatment hours\n\nper week;\n\n10. \"Short-term supportive care\" means a service rendered to\n\nany person residing in a halfway house or transitional living\nnt,\n\nmental health services or treatment services. The terms do not\n\ninclude residential substance abuse centers which are facilities\n\nthat provide treatment for consumers in a live-in setting that\n\nprovides a regimen consisting of twenty-four (24) treatment hours\n\nper week;\n\n10. \"Short-term supportive care\" means a service rendered to\n\nany person residing in a halfway house or transitional living\n\nfacility which is sufficient to assist the person to meet or achieve\n\nan adequate level of daily living and to learn or develop adequate\n\ndaily living skills. Daily living skills shall include, but not be\n\nlimited to, resident participation in meal preparation and routine\n\nhousekeeping and laundry tasks. Short-term supportive assistance\n\nincludes, but is not limited to, assistance in the preparation of\n\nmeals, housekeeping, laundry tasks and personal hygiene. Short-term\n\nsupportive assistance shall not include medical services or personal\n\ncare as defined in Section 1-820 of Title 63 of the Oklahoma\n\nStatutes;\n\n11. \"Treatment\" means the broad range of emergency, inpatient,\n\nintermediate and outpatient services and care, including diagnostic\n\nevaluation, medical, psychiatric, psychological and social service\n\ncare, vocational rehabilitation and career counseling, which may be\n\nextended to alcohol-dependent, intoxicated and drug-dependent\n\npersons; and\n\n12. \"Faith-based\" means an organization, association, facility\n\nor program that offers services within a context of religious\n\nbeliefs that are articulated by the organization's, association's,\n\nfacility's or program's mission statement, affiliations, or\n\nsponsoring entities.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7fee745eb12642973a67271f3be82a1999c74e0ee0c0f9bce51a33ab9e0bfca6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-3-402","next":"us-ok/okla.-stat.-tit.-43a-43a-3-405"},"notice":"GroundRules: Original legal text.
