Stat. tit. 43A, § 43A-3-415","heading":"Certified Services for the Alcohol and Drug Dependent –","body":"Exemptions – Fees to defray costs – Financial information of\n\napplicants.\n\nA. 1. The Board of Mental Health and Substance Abuse Services\n\nshall promulgate rules and standards for certification for private\n\nfacilities and organizations which provide treatment, counseling,\n\nrecovery and rehabilitation services directed toward alcohol- and\n\ndrug-dependent persons. These facilities and organizations shall be\n\nknown as \"Certified Services for the Alcohol- and Drug-Dependent\".\n\nOnly certified facilities may receive and assist alcohol- and drug-\n\ndependent persons by providing treatment, recovery support and\n\nrehabilitation.\n\n2. Any person violating the requirement that only certified\n\nfacilities may receive and assist alcohol- and drug-dependent\n\npersons by providing treatment to alcohol- and drug-dependent\n\npersons, upon conviction, shall be guilty of a misdemeanor. Except\n\nas otherwise provided in this section, no substance abuse treatment\n\nprogram shall operate or continue to operate unless the facility\n\ncomplies with the rules promulgated by the Board and is certified as\n\nrequired by this section.\n\nB. Applications for certification as a certified service for\n\nthe alcohol- and drug-dependent person pursuant to the provisions of\n\nthis section shall be made to the Department of Mental Health and\n\nSubstance Abuse Services on prescribed forms.\n\nC. The Board, or the Commissioner of Mental Health and\n\nSubstance Abuse Services upon delegation by the Board, may certify\n\nthe facility for a period of not more than thirty-six (36) months\n\nsubject to renewal as provided.\n\nD. The Board, or the Commissioner of Mental Health and\n\nSubstance Abuse Services upon delegation by the Board, may postpone,\n\ndeny renewal of, revoke, or suspend the certification of the\n\nfacility for failure to comply with rules and standards promulgated\n\nby the Board.\n\nE. The following are exempt from the provisions of the Oklahoma\n\nAlcohol and Drug Abuse Services Act:\n\n1. Individual persons in private practice as licensed\n\nphysicians, licensed psychologists, licensed social workers,\n\nregistered nurses, licensed professional counselors, licensed\n\nmarriage and family therapists, licensed behavioral practitioners,\n\nindividual members of the clergy, licensed alcohol or drug abuse\n\ncounselors and certified alcohol or drug abuse counselors. The\n\nexemption shall apply only to individual professional persons in\n\ntheir private practice and not to any treatment facility operated by\n\nthe person;\n\n2. Properly licensed hospitals, psychiatric and medical\n\nsurgical facilities;\n\n3. Programs or facilities operated by a state agency;\n\n4. Programs conducted and facilities operated by Alcoholics\n\nAnonymous;\n\n5. Programs conducted and facilities operated by the Salvation\n\nArmy;\n\n6. Faith-based, nonresidential recovery programs;\n\n7. Residential recovery-based programs with a resident capacity\n\nof less than twelve;\n\n8. Residential recovery and recovery support programs that are\n\nnot collocated with certified treatment programs. However, the\n\nDepartment of Mental Health and Substance Abuse Services shall offer\n\nvoluntary certification for those resident recovery and recovery\n\nsupport programs that are not collocated with certified treatment\n\nprograms that desire Department certification; or\n\n9. Services provided by a health center as defined in the\n\nPublic Health Service Act, 42 U.S.C., Section 254b, except for\n\nservices listed in Levels 2.1 through 4 of the Levels of Care\n\ndescribed in the American Society of Addiction Medicine Criteria.\n\nF. Certified services for the alcohol- or drug-dependent person\n\nshall comply with standards adopted by the Board. Such standards\n\nshall require that treatment and therapeutic methods shall be in\n\ncompliance with:\n\n1. The Joint Commission on Accreditation of Healthcare\n\nOrganizations;\n\n2. The Commission on Accreditation of Rehabilitation\n\nFacilities;\ntified services for the alcohol- or drug-dependent person\n\nshall comply with standards adopted by the Board. Such standards\n\nshall require that treatment and therapeutic methods shall be in\n\ncompliance with:\n\n1. The Joint Commission on Accreditation of Healthcare\n\nOrganizations;\n\n2. The Commission on Accreditation of Rehabilitation\n\nFacilities;\n\n3. The Council on Accreditation (COA); or\n\n4. Approved medical and professional standards as determined by\n\nthe Board.\n\nG. Any facility or organization certified to provide certified\n\nservices shall cooperate with inspection personnel of the state and\n\nshall promptly file all reports required by the Board.\n\nH. All claims by and accomplishments publicized by any\n\napplicant for certification or any certified alcohol- or drug-\n\ndependent organization, including but not limited to consumer count\n\nand success rates, shall be documented and verifiable by the Board.\n\nI. The Department of Mental Health and Substance Abuse Services\n\nis authorized to establish and collect certification and renewal\n\nfees for certification of private facilities and organizations which\n\nprovide treatment, counseling and rehabilitation services directed\n\ntoward alcohol- and drug-dependent persons, as provided in Section\n\n3-324 of this title.\n\nJ.
