Stat. tit. 43A, § 43A-3-417.1","heading":"Transitional living centers and halfway houses –","body":"Nondiscriminatory zoning laws.\n\nAny transitional living center or halfway house, as defined in\n\nSection 3-403 of this title, shall be subject to the\n\nnondiscriminatory zoning laws of the state, county or municipality\n\nin which located, and the location of such facility is specifically\n\nprohibited within one thousand (1,000) feet of any public or private\n\nelementary or secondary school. Provided, that if any public or\n\nprivate elementary or secondary school shall be established within\n\nthe prohibited distance from any such facility after such facility\n\nhas been in use as a transitional living center or halfway house,\n\nthis shall not be a bar to the continued use of the facility as\n\ndesignated so long as it remains in continuous use as designated.\n\nThe distance indicated in this section shall be measured from the\n\nnearest property line of the school to the nearest property line of\n\nthe transitional living center or halfway house.
