Subject to the restrictions imposed by subsection B of this\n\nsection, a consumer in an inpatient or residential mental health or\n\nsubstance abuse facility has the right to:\n\n1. Receive a reasonable number of visitors at reasonable times;\n\n2. Reasonable access to make and receive telephone calls;\n\n3. Communicate by uncensored and sealed mail; and\n\n4. Writing materials and reasonable amounts of postage if\n\nunable to procure the same.\n\nB. The rights provided in subsection A of this section are\n\nsubject to the general rules of the facility and may be restricted\n\nby the treatment team ultimately responsible for the consumer’s\n\ntreatment to the extent that the restriction is necessary to the\n\nconsumer’s welfare, to protect another person, or to the security of\n\nthe facility; provided, however, the right to communicate with legal\n\ncounsel, a treatment advocate, or the Department may not be denied.\n\nC. If a restriction is imposed under this section, the reasons\n\nfor the restriction and the duration of the restriction shall be\n\ndocumented in the consumer’s clinical record.
