Stat. tit. 43A, § 43A-3-452","heading":"Sentence and punishment - Conditional participation in","body":"alcohol and drug substance abuse course or program.\n\nExcept as otherwise provided by law, in any case in a municipal\n\nor district court of proper jurisdiction wherein the defendant is\n\ncharged with actual physical control of or operation of a motor\n\nvehicle while under the influence of or impaired by alcohol or a\n\ndrug, the court may:\n\n1. Upon a plea of guilty or nolo contendere, or stipulation by\n\nthe defendant, or a verdict, but before a judgment of guilt is\n\nentered, without entering a judgment of guilt and with the consent\n\nof the defendant, defer further proceedings upon the condition that\n\nthe defendant enroll in, attend and successfully complete, at his or\n\nher own expense, an alcohol and drug substance abuse course or an\n\nalcohol and drug substance abuse treatment program, or both as\n\nidentified by an assessment conducted by a certified assessor; or\n\n2.
