Alcohol and drug substance abuse courses shall be offered\n\nonly by nonprofit educational institutions of higher learning,\n\ngovernmental or nonprofit organizations.\n\nB. Enrollment fees for those attending the courses shall be set\n\nby the Department of Mental Health and Substance Abuse Services and\n\nshall be within a range of not less than Sixty-five Dollars ($65.00)\n\nand not more than:\n\n1. One Hundred Fifty Dollars ($150.00) for a ten-hour course;\n\nand\n\n2. Three Hundred Sixty Dollars ($360.00) for a twenty-four-hour\n\ncourse.\n\nC. Ten percent (10%) of each fee collected shall be remitted by\n\nthe institution or organization offering alcohol and drug substance\n\nabuse courses to the State Treasurer to be credited to the\n\nCommunity-based Substance Abuse Revolving Fund in the State Treasury\n\nand shall be used to provide substance abuse services to the\n\nindigent or to provide specialized training to alcohol and drug\n\nsubstance abuse course facilitators. Five percent (5%) of each fee\n\ncollected by the Department shall be used for the administrative\n\ncosts related to providing such services.\n\nD. Enrollment in the course shall not be limited to persons\n\nordered to enroll, attend and successfully complete the course.\n\nE. All alcohol and drug substance abuse courses related to\n\ndriver license revocation and course facilitators shall be approved\n\nand certified by the Department of Mental Health and Substance Abuse\n\nServices.\n\nF. The Department of Mental Health and Substance Abuse Services\n\nis authorized to promulgate rules governing:\n\n1. Minimum curriculum requirements for such courses;\n\n2. Facilities, equipment and instructional materials for such\n\ncourses;\n\n3. Minimum qualifications for course facilitators;\n\n4. Grounds for reprimand and for revocation, suspension or\n\nnonrenewal of the authority to conduct such courses and for\n\nrevocation of a facilitator's certification;\n\n5. Attendance requirements; and\n\n6. Guidelines for certifying to the Department of Mental Health\n\nand Substance Abuse Services and the Department of Public Safety\n\nsuccessful completion of such course.\n\nG. The Department of Mental Health and Substance Abuse Services\n\nshall require that each ten-hour course shall be conducted in no\n\nless than three sessions of no more than three and one-half (3 1/2)\n\nhours each on three (3) separate days. For a twenty-four-hour\n\ncourse, the Department shall require that:\n\n1. Each such course shall consist of at least twenty-four (24)\n\nhours;\n\n2. Each such course shall consist of no more than two (2) hours\n\nof education on any given day, nor more than four (4) hours in a\n\ngiven week, and shall not contain more than ten percent (10%) films\n\non any one specialized area; and\n\n3. No more than twenty-four students shall be allowed in a\n\ngiven class.\n\nH. Any institution or organization authorized under this act to\n\nconduct an alcohol and drug substance abuse course shall certify to\n\nthe Department of Public Safety all persons who successfully\n\ncomplete such course.\n\nI. Any person participating in a substance abuse treatment\n\nprogram recommended as a result of an assessment pursuant to Section\n\n3-460 of this title shall be required to pay all or part of the\n\nactual cost incurred for treatment of the person, if the court\n\ndetermines the person has the ability to pay for all or part of the\n\ncost of treatment. The court shall determine the amount of\n\nreimbursement the person shall pay.\n\nJ. Application fees for certification of course facilitators\n\nshall be set by the Board of Mental Health and Substance Abuse\n\nServices to defray the costs of administering the program and shall\n\nbe:\n\n1. Not less than One Hundred Dollars ($100.00) and not more\n\nthan Two Hundred Dollars ($200.00) upon initial application; and\n\n2. Not less than Twenty-five Dollars ($25.00) and not more than\n\nFifty Dollars ($50.00) upon annual renewal.\n\nK. The Director of the Office of Management and Enterprise\nal Health and Substance Abuse\n\nServices to defray the costs of administering the program and shall\n\nbe:\n\n1. Not less than One Hundred Dollars ($100.00) and not more\n\nthan Two Hundred Dollars ($200.00) upon initial application; and\n\n2. Not less than Twenty-five Dollars ($25.00) and not more than\n\nFifty Dollars ($50.00) upon annual renewal.\n\nK. The Director of the Office of Management and Enterprise\n\nServices shall transfer unobligated monies generated from the fees\n\nin subsection C of this section, deposited before November 1, 2005,\n\nfrom the Department of Mental Health and Substance Abuse Services\n\nRevolving Fund to the Community-based Substance Abuse Revolving\n\nFund, in amounts calculated by the Department.\n\nL.
