The Department of Mental Health and Substance Abuse Services\n\nshall certify assessment personnel for the purpose of conducting\n\nalcohol and drug assessment and evaluation programs related to\n\ndriver license revocation.\n\nB. Application fees for certification of assessment personnel\n\nshall be set by the Department to defray the costs of administering\n\nthe program and shall be:\n\n1. Not less than One Hundred Dollars ($100.00) and not more\n\nthan Two Hundred Dollars ($200.00) upon initial application; and\n\n2. Not less than Twenty-five Dollars ($25.00) and not more than\n\nOne Hundred Fifty Dollars ($150.00) upon triennial renewal.\n\nC. The fee for those undergoing an assessment and evaluation\n\npursuant to this section shall be One Hundred Sixty Dollars\n\n($160.00). A fee of Fifteen Dollars ($15.00) shall be remitted by\n\nthe individual undergoing an assessment and evaluation directly to\n\nthe Department of Public Safety pursuant to Section 6-212 of Title\n\n47 of the Oklahoma Statutes.\n\n1. The Department of Public Safety shall remit ninety percent\n\n(90%) of the fifteen-dollar fee collected pursuant to this section\n\nto the State Treasurer to be credited to the Community-based\n\nSubstance Abuse Revolving Fund in the State Treasury and shall be\n\nused by the Department of Mental Health and Substance Abuse\n\nServices.\n\n2. Ten percent (10%) of each fifteen-dollar fee collected by\n\nthe Department of Public Safety pursuant to this section shall be\n\ndeposited into the Department of Public Safety Restricted Revolving\n\nFund, as created in Section 2-145 of Title 47 of the Oklahoma\n\nStatutes, to be used for administrative costs associated with the\n\nduties imposed by this section.\n\nD. The Board of Mental Health and Substance Abuse Services is\n\nauthorized to promulgate such rules as are necessary to implement\n\nthe provisions of Section 3-451 et seq. of this title. Failure to\n\ncomply with rules and standards promulgated by the Board shall be\n\ngrounds for revocation, suspension or nonrenewal of certification.\n\nE. The Director of the Office of Management and Enterprise\n\nServices shall transfer any unobligated monies generated by the fees\n\nin subsection C of this section, deposited before November 1, 2005,\n\nfrom the Department of Mental Health and Substance Abuse Services\n\nRevolving Fund to the Community-based Substance Abuse Revolving\n\nFund, in amounts calculated by the Department.\n\nF.
