Stat. tit. 43A, § 43A-3-702","heading":"Prisoners in need of mental health treatment –","body":"Determination of ability to consent - Transfer to facility –\n\nDischarge – Costs - Expiration of sentence - Commitment.\n\nWhen a person confined in a penal or correctional institution or\n\nreformatory of this state is evaluated as provided by law by a\n\nlicensed mental health professional to be a person requiring\n\ntreatment as defined in Section 1-103 of this title, the district\n\ncourt may order the inmate’s transfer to a facility, or unit within\n\nthe Department of Corrections and make a determination of whether\n\nthe inmate is capable of consenting to or refusing treatment that is\n\nordered including, but not limited to, the right to refuse\n\nmedication, pursuant to the laws governing involuntary commitment,\n\nwhere the inmate shall remain until the person in charge of the\n\ncorrectional institution or unit, or the physician which received\n\nthe inmate determines that the inmate has improved to the point that\n\nthe inmate may be discharged pursuant to the laws of this title\n\ngoverning discharge. If the sentence expires during the time of a\n\nprisoner's involuntary commitment at the correctional institution,\n\nand the prisoner is still a person requiring treatment, the person\n\nin charge of the correctional institution shall immediately\n\ninstigate proceedings for commitment to the custody of the\n\nDepartment of Mental Health and Substance Abuse Services or to a\n\nprivate facility willing to accept the person for treatment under\n\nthe procedures provided in this title.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"faab6821a82c8833b258b7648406c99255cdb927049ec917ec5eaa73114e7812","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-3-701a","next":"us-ok/okla.-stat.-tit.-43a-43a-3-704"},"notice":"GroundRules: Original legal text.
