Stat. tit. 43A, § 43A-3-704","heading":"Mental health and substance abuse evaluation -","body":"Convicted felons.\n\nAfter an initial appearance, a person accused of a felony\n\noffense may submit to an approved risk, mental health and substance\n\nabuse assessment and evaluation which shall be administered and\n\nscored by assessment personnel certified by the Department of Mental\n\nHealth and Substance Abuse Services. Any person lacking sufficient\n\nskills to comprehend or otherwise participate in the risk, mental\n\nhealth and substance abuse assessment and evaluation shall have\n\nappropriate assistance. The court, district attorney, arrested\n\nperson and counsel for the arrested person shall have access to the\n\nresults of the risk, mental health and substance abuse assessment\n\nand evaluation. The results of the risk, mental health and\n\nsubstance abuse assessment and evaluation shall not be admissible as\n\nevidence in the criminal case unless specifically waived by the\n\ndefendant or for purposes of determining sentencing options for a\n\ndefendant who has pled guilty and punishment is to be determined at\n\nthe discretion of the court.
