Mechanical restraints shall not be applied to a consumer\n\nunless:\n\n1. It is determined by an allopathic physician, osteopathic\n\nphysician, physician assistant or advanced practice registered nurse\n\nwho is authorized to order restraint by hospital or community-based\n\nstructured crisis center, as defined by Section 3-317 of this title,\n\npolicy to be required by the medical needs of the consumer; or\n\n2. An emergency situation arises and a mechanical restraint is\n\nnecessary for the safety of the individual or others. The\n\nmechanical restraint may be applied after obtaining a verbal order\n\nof an allopathic physician, osteopathic physician, physician\n\nassistant or advanced practice registered nurse as long as the\n\nconsumer receives a face-to-face examination within one (1) hour\n\nafter the restraint is applied by an allopathic physician,\n\nosteopathic physician, physician assistant, advanced practice\n\nregistered nurse or registered nurse trained in restraint management\n\nin accordance with the then-current standards promulgated by the\n\nUnited States Department of Health and Human Services and authorized\n\nby hospital policy.\n\nB. No mechanical restraint shall be continued for longer than\n\nis absolutely necessary under the circumstances.
