A person receiving treatment for mental illness or alcohol-\n\nor drug-dependency may perform labor which contributes to the\n\noperation and maintenance of the facility for which the facility\n\nwould otherwise employ someone only if:\n\n1. The consumer voluntarily agrees to perform the labor;\n\n2. Engaging in the labor would not be inconsistent with the\n\ntreatment plan for the consumer;\n\n3. The amount of time or effort necessary to perform the labor\n\nwould not be excessive;\n\n4. The consumer is compensated appropriately and in accordance\n\nwith applicable federal and state minimum wage laws; and\n\n5. Discharge and privileges are not conditioned upon the\n\nperformance of such labor.\n\nB. The provisions of this section shall not apply to bona fide\n\n“work therapy” which is a part of the treatment program.\n\nWork therapy shall be:\n\n1. In the best interests of the person;\n\n2. Therapeutic in nature and purpose;\n\n3. Part of the treatment plan of the person;\n\n4. Documented in the treatment record with a rationale for the\n\nwork therapy;\n\n5. Voluntarily entered into by the person;\n\n6. Compensated by the facility at a rate derived from the value\n\nof the work performed; and\n\n7. Compensated in accordance with federal and state minimum\n\nwage law if the primary benefit is to the facility.\n\nC. The provisions of subsections A and B of this section shall\n\nnot apply to personal housekeeping, personal maintenance, or\n\ncommunal living, or tasks oriented to improving life skills. These\n\nactivities shall not primarily benefit the facility.\n\nD.
