The Board of Mental Health and Substance Abuse Services may\n\npromulgate rules authorizing the executive director or designee of a\n\nfacility within the Department of Mental Health and Substance Abuse\n\nServices at which a consumer is being treated to charge on a sliding\n\nscale or waive the liability of the consumer and estate of the\n\nconsumer for the care and treatment of the consumer, if it is\n\ndetermined that the consumer is unable to pay the full amount for\n\nsuch care and treatment, or that the consumer is an indigent person\n\nas defined in this title.\n\nB. Before any charge for care and treatment is placed on a\n\nsliding scale or waived there must be:\n\n1. A written application and documentation demonstrating the\n\nincome of the consumer;\n\n2. The number of dependents of the consumer;\n\n3. A statement of any charges to be placed on the sliding scale\n\nor waiver of indebtedness of the consumer for care and treatment;\n\nand\n\n4. The reasons for the placement on the sliding scale or\n\nwaiver. The statement must be signed by the executive director or\n\ndesignee granting such placement on the sliding scale or waiver.\n\nThe statement must also be filed with the records of the consumer at\n\nthe facility.\n\nC. For the purpose of determining the financial status or\n\nability to pay of a consumer, the estate of the consumer, or persons\n\nliable for the care and treatment of the consumer, the Oklahoma Tax\n\nCommission is directed to furnish to the Commissioner of Mental\n\nHealth and Substance Abuse Services, or designee, upon request, such\n\ninformation as may be of record in the Commission relative to\n\nconsumers, and their estates.","path":["OK Code","Title 43A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os43A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e3503b64b6d22fc64d9ceb6de9866b3bebbcc9184a04f5a5909f2bff58f0fe34","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-43a-43a-4-202","next":"us-ok/okla.-stat.-tit.-43a-43a-4-204"},"notice":"GroundRules: Original legal text.
