Stat. tit. 43A, § 43A-5-202","heading":"Confinement of persons alleged or adjudged mentally","body":"ill, alcohol-dependent or drug-dependent.\n\nWhen any person alleged in any court to be mentally ill,\n\nalcohol-dependent, or drug-dependent, or shall have been adjudged to\n\nbe mentally ill, alcohol-dependent, or drug-dependent and shall be\n\nin the legal custody of the county sheriff as prescribed by law, if\n\nsuch person has not been charged with commission of a crime, the\n\nsaid county sheriff is hereby authorized to confine such person in a\n\nplace other than the county jail to be selected by said county\n\nsheriff and to transport such person to the place selected; provided\n\nthat such confinement shall be in a place and manner so as to\n\nprevent such confined person from in any way endangering himself or\n\nany other person. The county is hereby directed to expend such\n\nfunds as may be necessary to provide for such confinement outside\n\nthe county jail. Specific authority is hereby granted the county\n\nsheriff and the county commissioners to enter into a contract with a\n\nnursing home or facility as a place of detention.
