Stat. tit. 43A, § 43A-5-204","heading":"Appropriate treatment and medication - Nonconsenting","body":"individuals - Immunity - Seclusion or restraint - Hearings while\n\nunder influence of psychotropic medication - Inmates committed to\n\nspecial care unit.\n\nA. Appropriate treatment and medication, including psychotropic\n\nmedication, may be administered to a consenting individual:\n\n1. During the detention periods authorized by the Mental Health\n\nLaw;\n\n2. During the time set forth in the Mental Health Law for the\n\nprecommitment screening examination; or\n\n3. While in the custody of the Department of Corrections.\n\nB. Treatment and medication may be administered to a\n\nnonconsenting individual upon the written order of the physician\n\nwho:\n\n1. Has personally examined the consumer;\n\n2. Finds the medication or treatment is necessary to protect\n\nthe consumer, the facility or others from serious bodily harm; and\n\n3. Notes in the medication record of the consumer, with an\n\nexplanation of the facts leading up to the decision to administer\n\ntreatment and medication including psychotropic medication.\n\nC. Any physician who orders medication in good faith and any\n\nemployee of the facility who administers medication in good faith\n\npursuant to the written order of a physician, under the provision of\n\nthis section, shall be immune from civil suits for damages that\n\noccur from the administration of medication.\n\nD. Seclusion or restraint may be administered to a\n\nnonconsenting individual upon the written order of a physician who:\n\n1. Personally examined the consumer; and\n\n2. Finds that seclusion or restraint is necessary to protect\n\nthe consumer, the facility, or other persons. The physician shall\n\nnote in the chart of the consumer an explanation of the decision to\n\nadminister seclusion or restraint, including administration of\n\npsychotropic medication. This shall not prohibit emergency\n\nseclusion or restraint, including mechanical restraint, pending\n\nnotification of a physician.\n\nE. If the consumer is under the influence of psychotropic\n\nmedication during any court hearing held pursuant to Section 5-415\n\nof this title, the court, and the jury, if any, shall be advised by\n\nthe district attorney at the beginning of the hearing that:\n\n1. The consumer is under the influence of psychotropic\n\nmedication;\n\n2. The purpose of the medication; and\n\n3. The effect which such medication may have on the actions,\n\ndemeanor and participation of the consumer at the hearing.\n\nF.
